November 5, 2013

The Moody County Commissioners met in regular session on Tuesday, November 5, 2013 in the County Commissioners' Room in the Courthouse at 9:00 AM, with the following members present: Chairman Rick Veldkamp, Jerry Doyle, Tom Ehrichs, Dan Miles, and Tom Peper, with Lori Schaefers, Auditor as Clerk of the Board. Also present was Billy Stitz of the Moody County Enterprise and County residents Merideth Barron and Janelle Weatherly.

Chairman Veldkamp called the meeting to order. Motion by Miles, seconded by Peper to approve the agenda as amended. All voted “aye”. Motion by Doyle, seconded by Ehrichs to approve the minutes of October 15, 2013. All voted “aye”.

Brenda Duncan, DOE met with the Board. Motion by Miles, seconded by Peper to authorize First District to obtain a copy of Moody County’s Pictometry countywide ortho mosaics. All voted “aye”. Duncan informed the Board that Deputy DOE DeAnna Berke passed her Certified Appraiser Assessor Exam. Motion by Peper, seconded by Ehrichs to approve the step increase of Deputy DOE DeAnna Berke to a Grade 16, Step B at $14.61/hour retro effective to November 4, 2013. All voted “aye”.

Motion by Doyle, seconded by Miles to conduct business as Joint Board of Commissioners and Board of Planning and Zoning at 9:05 AM. All voted “aye”. Also present was Director of Equalization Brenda Duncan. Three plats were reviewed. Motion by Peper, seconded by Miles to approve the following resolution with all members voting “aye”:

COUNTY COMMISSION

“BE IT RESOLVED by the County Commission of Moody County, South Dakota, that the plat of TRACT 2 OF RICHTER’S ROCKY RIDGE ACRES ADDITION IN THE SOUTHEAST QUARTER OF SECTION 13, TOWNSHIP 106 NORTH, RANGE 50 WEST OF THE 5TH PRINCIPAL MERIDIAN, MOODY COUNTY, SOUTH DAKOTA, be and the same is hereby approved.

I hereby certify that the above is a correct copy of the resolution passed by the County Commission, at a meeting held on the date adopted.

It was moved by Miles, seconded by Doyle, motion carried that the plat of LOT 1 AND LOT 2 OF ENTRINGER ADDITION IN THE SE1/4 OF SECTION 23-T107N-R50W OF THE 5TH P.M., MOODY COUNTY, SOUTH DAKOTA as described above and hereon be approved and accepted and the Chairman is hereby instructed to endorse on such plat this resolution and to certify the same.

Motion by Peper, seconded by Miles to resume regular session at 9:10 AM. All voted “aye”.

Troy Wellman, Sheriff met with the Board. Motion by Doyle, seconded by Ehrichs to approve the 2013 Lake County Inmate Housing Contract. All voted “aye”. Motion by Ehrichs, seconded by Peper to approve the purchase of a safety vest from Neve’s Equipment of Sioux Falls in the amount of $785.90. All voted “aye”. Motion by Miles, seconded by Peper to hire Emily Quick as a full-time Dispatcher with a starting wage of $11.54/hour effective November 18, 2013. All voted “aye”.

Marc Blum, Highway Superintendent met with the Board to discuss various highway projects and equipment, and to inform the Board that the County Highway Department will revert to their winter hours, operating 5 days a week, 7:00 am until 3:30 pm effective November 25, 2013.

Julie Krejchi with AFLAC met with the Board to review AFLAC benefits.

County resident Meredith Barron left the meeting. County resident Gordon Leraas joined the meeting.

Scott Lewis, Custodian, along with Darrel Statema from Access Elevator & Lifts, Inc. met with the Board to discuss the lift at the south entrance of the courthouse. Motion by Doyle, seconded by Miles to approve the contract with Access Elevator and Lifts of Omaha, NE to furnish and install a Garaventa Opal Vertical Platform Lift model GVL-OP-72 at the south entrance of the courthouse for the amount of $15,500.00, with payment due upon completion of the installation. The approval is contingent on the review of the contract by the State’s Attorney. All voted “aye”.

Mark Bonrud, Ambulance Supervisor met with the Board to present the October 2013 ambulance report. Motion by Ehrichs, seconded by Doyle to authorize the Ambulance Department to hold a 3-month EMT class starting November 5, 2013. All voted “aye”.

County resident Jan Gullickson joined the meeting.

Paul Lewis, State’s Attorney met with the Board to discuss the County implementing a nuisance ordinance. Motion by Peper, seconded by Miles to table the proposed nuisance ordinance. All voted “aye”.

Motion by Miles, seconded by Doyle to enter into executive session at 11:08 AM pursuant to SDCL 1-25-2. Reason: legal matters. All voted “aye”. Motion by Miles, seconded by Peper to resume regular session at 11:30 AM. All voted “aye”.

All additional attendees, excluding Billy Stitz, left the meeting.

Brad Ciavarella, Architect met with the Board. Also present was Scott Lewis - Custodian, Dan Peterson of Hander Inc., Marshall Thome of Krohmer Plumbing, Adam Redlinger of Reglinger Bros., and David Ekern of Ekern Home Equipment. As advertised the bids for the Moody County Courthouse HVAC System Replacement were opened. The following bids were received:

The Board will review the bids at the next Commission meeting to be held on November 19, 2013.

Motion by Peper, seconded by Miles to authorize all interested elected and appointed officials to attend the District Meeting in Codington County on November 18, 2013. All voted “aye”.

Motion by Peper, seconded by Ehrichs to hold the second Commission meeting in January on January 28, 2014. All voted “aye”.

Jud Krull - Flandreau Fire Chief, Jason Landis - Colman Fire Chief, and Bob Dickey - Trent Fire Chief met with the Board. Also present were Terry Albers - Emergency Manager and Mark Bonrud - Flandreau City Mayor. Discussion was held on fire protection for the City of Egan.

Motion by Doyle, seconded by Ehrichs to authorize the Moody County Time Capsule Committee to temporarily use the Moody County Tax ID number for a checking account. All voted “aye”.

Motion by Peper, seconded by Miles to enter into executive session at 1:22 PM pursuant to SDCL 1-25-2. Reason: personnel. All voted “aye”. Motion by Ehrichs, seconded by Peper to resume regular session at 1:45 PM. All voted “aye”.

Kay Peterson, Deputy Auditor met with the Board to present poor relief cases. Motion by Peper, seconded by Miles to deny case #20131001 as prior approval is required for non-emergency admissions. All voted “aye”. Motion by Miles, seconded by Doyle to deny case #20130602 as the patient has the ability to pay. All voted “aye”. Motion by Doyle, seconded by Peper to deny case #20130601 as the patient has the ability to pay. All voted “aye”.

Auditor Schaefers reviewed the 2013 expenditure and revenue budgets with the Board.

Motion by Ehrichs, seconded by Peper to approve the following resolution, with all members voting “aye”:

WHEREAS, Commissioner Contingency Funds are included in the annual budget, and

WHEREAS, insufficient funds were provided to the Modernization and Preservation Fund;

Motion by Miles, seconded by Doyle to approve the automatic budget supplement to the Sheriff’s Repair Budget in the amount of $3715.71 due to unanticipated insurance revenue. All voted “aye”.

Motion by Miles, seconded by Peper to authorize the County courthouse and Sheriff’s Office to apply for the SDBI Technology Planning and Computer Ownership Grant. All voted “aye”.

Motion by Ehrichs, seconded by Doyle to accept the resignation of Highway Worker Jeremy Elverud effective November 14, 2013.

Kari Anderson, Deputy Auditor met with the Board to discuss the 2014 wages and 2014 Affordable Care Act Fees, which are taxes added to the health insurance premiums. Motion by Miles, seconded by Peper to approve a 5% wage increase for County employees effective January 1, 2014. All voted “aye”. Motion by Ehrichs, seconded by Doyle to pass the Transitional Reinsurance Fee and Annual Health Insurance Fee onto the employees, adding the fees to the employee’s share of the health insurance premium. All voted “aye”.
