These notices satisfy two separate but related procedural requirements for activities to be undertaken by Nonprofit Grantee.

REQUEST FOR RELEASE OF FUNDS

On or about Date, MSHDA will submit a request to HUD for the release of funds for Nonprofit Grantee's HOME, CDBG, other (identify)Homeowner Rehab, Homebuyer, etc. Program under:

Title I of the Housing and Housing InitiativesAct of 1974, as amended (CDBG)

Title II (HOME Investment Partnership Act) of the Cranston-Gonzalez National Affordable Housing Act of 1990, as amended

Other:

Program funds will be used to undertake a project known as Project Name for the purpose of Nature/scope, estimated funding amounts (include other HUD and non-HUD funding sources if applicable) and sources, and project location -- include boundaries if target area .

FINDING OF NO SIGNIFICANT IMPACT

MSHDA has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.

For tiered review projects. The Tier I broad assessment of the project area revealed no serious environmental adverse impacts for: N/A if not tiered, or, list the 58.5 authorities cleared in Tier I. Use factors as stated on Tiered Review Strategy form (no acronyms). Tier II site-specific environmental analyses will be conducted as project sites are identified and will include the following factors: Enter N/A (if not tiered) or list the environmental factors to be analyzed on Tier II checklist. List factors exactly as stated on Tiered Review Strategy form (no acronyms).

Additional project information is contained in the Environmental Review Record (ERR) on file at the Housing Initiatives Division of MSHDA, 735 E. Michigan Avenue, Lansing, MI 48912. The record is available for review and may be examined or copied weekdays, 8 a.m. to 5 p.m.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to MSHDA’s Housing Initiatives Division. All comments received by Last day of first comment period will be considered by MSHDA prior to requesting a release of funds from HUD. Comments should specify which Notice is being addressed.

ENVIRONMENTAL CERTIFICATION

MSHDA certifies to HUD that MSHDA and NAME, MSHDA Certifying Officer,consent to accepting the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Nonprofit Grantee to use program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and MSHDA’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of MSHDA; (b) MSHDA has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U.S. Department of Housing and Urban Development—Detroit Field Office, Patrick V. McNamara Federal Building, 477 Michigan Avenue, Room 1710, Detroit, Michigan 48226-2592, Attn: Keith Hernandez, Director. Potential objectors should contact HUD to verify the actual last day of the objection period.
