The plans recommended for approval under the Town and Country Planning Acts will be subject to the standard conditions referred to in Minute No. 208 (April, 1971) of the Plans Sub-Committee, Barrow-in-Furness, County Borough Council, in addition to any conditions indicated hereunder.

Dr Raj GhumanErection of a two storey side extension forming ground floor kitchen and utility with two bedrooms over 2 Duddon Drive, Barrow-in-Furness as shown on plan number 2009/0951.

2.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Amendment) (No. 2) (England) Order, 2008 (or any Order revoking or re-enacting that Order with or without modifications) no additional opening of any kind shall be made in the upper floor of the permitted extension without the prior written consent of the Planning Authority.

Reason

In order to protect the residential amenities of neighbouring properties from overlooking or perceived overlooking.

Reason for approval

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act and all other material considerations, and subject to the proposed conditions, the development as proposed by reason of its location, design and orientation, will not have a detrimental impact upon the neighbouring properties of the visual amenities of the area. As such, the proposal complies with the Development Plan for the area, specifically policy B14.

High Speed Motor Boats Conversion of ground floor outrigger from (Windermere) Ltd offices to incorporate into approved dwelling (Flat 1) at 98-100 Duke Street, Dalton-in- Furness as shown on plan number 2009/1310.

2.The conversion shall be carried out in strict accordance with the planning application dated 6/8/09 and attached drawings (numbered 2915/18D, 2915/24, 2915/22A and 2915/23B).

2.The development must be carried out in accordance with the application and plans received by the Planning Authority on 24th August, 2009.

Reason

To ensure that the development is carried out only as indicated on the drawings approved by the Planning Authority.

3.The front and sides of the dormer must be clad in vertically hung, green marley tiles and permanently retained in that material, unless the Planning Authority gives its prior written authority for any variation.

Reason

In the interests of visual amenity, it is important that the dormer appears as an integral part of the roof, in accordance with saved policies B18 and D21 of the former Local Plan Review 1996-2006.

4.There must be no openings within the north eastern facing elevation of the rear extension hereby approved unless the prior written consent of the Planning Authority is given.

Reason

In order to protect the privacy of the occupiers of the adjoining property from direct overlooking, in accordance with saved policy B15 of the former Local Plan Review 1996-2006.

Reason for approval

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act and all other material considerations, and subject to the proposed conditions, the development as proposed by reason of its location, design and orientation, will not have a detrimental impact upon the neighbouring properties of the visual amenities of the area. Hydrocarbon Resources LtdHazardous Substance Consent for the storage of methanol and methanol-water at South Morecambe Terminal, Ramspide Road, Barrow-in-Furness as shown on plan number 2009/0265.

1.The hazardous substance(s), and amounts thereof, shall not be kept or used other than in accordance with the particulars on the application form, nor outside the area(s) marked for storage of the substance(s) on the plan(s) which formed part of the application.

Reason

In the interests of public and environmental safety and in order to ensure compliance with saved policy A9 of the former Borough of Barrow-in-Furness Local Plan Review 1996-2006.

Mrs A. MarksErection of a rear conservatory at 9 Thurlow Way, Barrow-in-Furness as shown on plan number 2009/1306.

2.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2008 (or any Order revoking or re-enacting that Order with or without modifications) no opening of any kind shall be made in the northwest facing elevation of the permitted extension without the prior written consent of the Planning Authority.

2.The materials to be used in the construction of the external surfaces, including walls, roofs, doors and windows, of the extension hereby permitted shall be of the same type, colour and texture as those used in the existing building.

To ensure a satisfactory appearance to the development, and to minimise its impact upon the surrounding area.

3.The materials to be used in the construction of the external surfaces, including walls, roofs, doors and windows, of the extension hereby permitted shall be of the same type, colour and texture as those used in the existing building.

Reason

To ensure a satisfactory appearance to the development, and to minimise its impact upon the surrounding area, thereby, complying with saved policy D21 of the former Barrow Borough Local Plan Review 1996-2006.

Reason for approval

6.Maximum brightness of the signage must not exceed 300 candelas per square metre as per the Lit Zone of the I.L.E. Recommendation.

Reason

To minimise light pollution in accordance with policy D63 of the Barrow Local Plan Review 1996-2006, and in order to minimise potential hazards for users of adjacent highways.

Reason for approval

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act and all other material considerations, and subject to the proposed conditions, the development as proposed by reason of its location, design and orientation, will not have a detrimental impact upon the neighbouring properties or the visual amenities of the area. As such, the proposal complies with the Development Plan for the area, specifically policy D43.

Mr and Mrs MilburnErection of a replacement garage in a revised location at 25 Duke Street, Askam-in-Furness as shown on plan 2009/1207.

2.The garage and access thereto must be reserved for the parking of private motor vehicles and no permanent development, whether permitted by the Town and Country Planning (General Permitted Development) Order, 1995 (or any Order revoking and re-enacting that Order with or without modifications) or not, shall be carried out on that area of land or in such position as to preclude vehicular access to the development hereby permitted.

Reason

To ensure that proper access and parking provision is made and retained for use associated with the development hereby permitted.

3.The development must be carried out in accordance with the application dated 29th April, 2009 and plans hereby approved as varied by the attached condition(s).

Reason

To ensure that the development is carried out only as indicated on the drawings approved by the Planning Authority.

Reason for approval

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act and all other material considerations, and subject to the proposed conditions, the development as proposed by reason of its location, design and orientation, will not have a detrimental impact upon the neighbouring properties or the visual amenities of the area. Mr J. GilchristNew shop front (retrospective) at 80 Duke Street, Barrow-in-Furness as shown on plan number 2009/1191.

2.The development must be carried out in accordance with the application dated 14th August, 2009 and the plans (Drawing No. 9114/09/1).

Reason

To ensure that the development is carried out only as indicated on the drawings approved by the Planning Authority.

3.The entrance to No. 80 Duke Street must be suitable for access by disabled persons unless it is otherwise agreed in writing with the Planning Authority that this is impractical.

Reason

In order to provide suitable access provision for disabled persons, thereby, complying with saved policy F13 of the former Barrow-in-Furness Borough Council Local Plan Review 1996-2006.

4.The external material(s) of the window opening on the front elevation which is indicated as being ‘blocked up’ on Drawing No. 9114/07/09/1 shall match the external finish of the front elevation as currently exists; unless the Planning Authority agrees in writing to any variation.

Reason

To ensure a satisfactory appearance to the development and to minimise its impact upon the surrounding area, complying with saved policy D21 of the former Barrow-in-Furness Borough Council Local Plan Review 1996-2006.

Reason for approval

That having regard to the provisions of Section 38(6) of the Planning and Compulsory Purchase Act and all other material considerations, and subject to the proposed conditions, the development as proposed by reason of its location, design and orientation, will not have a detrimental impact upon the neighbouring properties or the visual amenities of the area. As such, the proposal complies with the Development Plan for the area, specifically policies C1, C10, D21 and F13.

Mr K. ArmisteadPermanent retention of existing mobile field and Miss H. Kellett shelters for livestock housing and erection of an agricultural building for storage of implements and hay (resubmission of 2008/0684 in a revised form) on land at Barrow House Farm, Woodbine, Newton-in-Furness as shown on plan number 2009/1308.

2.The development must be carried out in accordance with the application dated 10th August, 2009 and the plans (sheets P-101; LP-001) hereby approved as varied by the attached conditions.

Reason

To ensure that the development is carried out only as indicated on the drawings approved by the Planning Authority.

3.The external elevations of the mobile buildings shall be given a stained finish within 60 days of the date of this consent and thereafter must be permanently retained.

Reason

To ensure a satisfactory appearance to the development and to minimise its impact upon the surrounding area having regard to saved policy D1 of the former Barrow-in-Furness Borough Council Local Plan Review 1996-2006.

4.The buildings hereby approved shall only be used for agricultural purposes, or for the keeping of horses on a recreational/leisure basis but excluding use as a riding school or for any other purpose failing within Class D2 of the Town and Country Planning (Uses Classes) Order 1987 or any Order revoking and re-enacting that Order with or without modifications.

Reason

In the interests of highway safety.

5.The application site shall not be used for the stationing of horse boxes, caravans or other vehicles or chattels associated with the use of the site for the keeping of horses.

Reason

To ensure a satisfactory appearance to the development and to minimise its impact upon the surrounding area having regard to saved policy D1 of the former Barrow-in-Furness Borough Council Local Plan Review 1996-2006.

6.No ranch style fencing shall be erected on the site except in accordance with a scheme which must have been first submitted to and approved in writing by the Planning Authority.

Reason

To ensure a satisfactory appearance to the development and to minimise its impact upon the surrounding area having regard to saved policy D1 of the former Barrow-in-Furness Borough Council Local Plan Review 1996-2006.

7.Within 60 days of the date of this consent a landscape scheme for the site, showing the trees, shrubs and hedgerows, including verges and other open spaces, together with details of any phasing of such a scheme must be submitted to and approved in writing by the Planning Authority. The scheme shall be submitted on a plan not greater that 1:500 in scale and shall contain details of numbers, locations and species of plants to be used. All planting and subsequent maintenance shall be to current British Standards. The approved scheme must subsequently be implemented by the end of the first planting season following initial beneficial occupation of the development or by such a programme as may be agreed in writing. Any trees or shrubs removed, dying being severely damaged or becoming seriously diseased within five years of planting shall be replaced by the landowner with trees or shrubs of a similar size and species to those originally required to be planted.

Reason

To ensure a satisfactory appearance to the development and to minimise its impact upon the surrounding area having regard to saved policy D1 of the former Barrow-in-Furness Borough Council Local Plan Review 1996-2006.

8.The external elevations and roof of the agricultural building hereby approved must be clad in a manufacturer-applied powder coated dark colour (BS4800 12B 29). The colouring of the external materials must be applied at the time of manufacture.

Reason

To ensure a satisfactory appearance to the development and to minimise its impact upon the surrounding area having regard to saved policy D1 of the former Barrow-in-Furness Borough Council Local Plan Review 1996-2006.
