EASEMENT AGREEMENT

GUILFORD COUNTY

THIS EASEMENT AGREEMENT (the “Agreement”), made this the _____ day of ______, 2006 by and between ______, citizen and resident of Greensboro, North Carolina (collectively "Grantor"), and ______, citizen and resident of Guilford County, North Carolina (collectively "Grantee").

W I T N E S S E T H:

WHEREAS, Grantor owns all that land described in that certain deed in Deed Book ____, page ____, Guilford County Registry ("Grantor's Property");

WHEREAS, Grantor's Property is adjacent and contiguous to the property of the Grantee which is described in Deed Book ____, Page ____, Guilford County Registry ("Grantee's Property"); and

WHEREAS, Grantee desires the right and privilege to come and go from Grantee’s Property over the Grantor’s Property; and

WHEREAS, Grantor is willing to grant to Grantee an easement to access the Grantee’s Property;

NOW, THEREFORE, in consideration of the sum of ONE DOLLAR ($1.00) paid to Grantor by Grantee, the receipt of which is hereby acknowledged, and other good and valuable consideration, Grantor hereby grants to Grantee, their heirs, successors and assigns, a permanent, non-exclusive easement over and across Grantor’s Property within the easement area more particularly described on Exhibit “A” hereto and incorporated herein by reference (the “Easement Area”) for the purpose of egress, regress to and from the Grantee’s Property. Grantor also grants to Grantee the right to enter and reenter upon the Easement Area for the purpose of inspecting, maintaining, and otherwise keeping in good repair the Easement Area.

TO HAVE AND TO HOLD the foregoing described easements to Grantee, their respective heirs, successors and assigns in title forever; it being agreed that the rights and easement hereby granted are for the use of, are appurtenant to and run with Grantor’s Property and Grantee’s Property, as applicable.

Grantor covenants that Grantor is seized of the Easement Area in fee simple and has the right to convey the easements described herein; that the applicable easements are free from encumbrances except as noted below, and will warrant the title to the same against the claims of all person whatsoever, except others using the easement areas described herein.

The designation Grantor and Grantee as used herein shall include said parties, their heirs, successors and assigns, and shall include singular, plural, masculine, feminine or neuter as required by context.
