An Ordinance of the Township of Bernards

Appropriating $200,000.00 for Pleasant Valley Pool Main Tank Rehabilitation and Other Related Repairs

Be it ordained by the Township Committee of the Township of Bernards in the County of Somerset, New Jersey that the sum of $80,000.00 is hereby appropriated from the Pool Commission Capital Improvement Fund, and $120,000.00 for the Bernards Township Capital Improvement Fundfor the following purposes:

$200,000.00 / Pool Main Tank Rehabilitation and Other Related Repairs

Any grant moneys received for the purposes described above hereof shall be applied to direct payment of the cost of the improvements and shall reduce the amount authorized from the Pool Commission Capital Improvement Fund to the extent that such funds are so used.

The period of usefulness is five years or more. The capital budget of the Township is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistencies herewith and the resolutions promulgated by the Local Finance Board showing all detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services are on file with the Township Clerk and are available for public inspection.

Be it further ordained, this ordinance shall take effect immediately upon final passage and publication in accordance with law.

Notice is hereby given that Bernards Township Ordinance # 2132 was introduced and passed on first reading at a meeting of the Township Committee, on 9/14/10, and was passed on final reading and adopted following a public hearing thereon at a regular meeting of the Governing Body of the Township of Bernards on 9/28/10.

Explanatory Statement:

Since 2004, the Pool Commission has allocated monies each year for the future re-plastering of the main pool.

A reserve study was conducted in 2009 of the entire Pleasant Valley Pool Facility. The Main Pool Surface was listed with 1 year remaining in its useful life and recommended for re-plastering prior to opening for the 2011 season. The Pool Commission contracted an engineering firm, Integrated Aquatics Engineering, Inc., to prepare bid specifications in preparation for work to begin after the pool closes for the 2010 season. A total of six bids were received and opened on 9/2/10 with the lowest base bid at $194,000, nearly double the estimate of Integrated Aquatics Engineering. The increase in cost is essentially unknown, but attributed to what the market is now dictating, and supported by similar results in other recent bid openings for re-plastering work.

The main pool is in desperate need for re-plastering. Several sections of racing lane tiles have come loose leaving the concrete work exposed. If the re-plastering project was delayed we would most likely spend $20,000 - $30,000 in repairs to open for the 2011 season, which only adds costs to the overall project. Integrated Aquatics Engineering recognizes the low bidder as well qualified for the work and with previous knowledge of our facility having completed re-plastering of the main pool in 1999.

This revised ordinance that replaces tabled Ordinance #2130 providing the increased funding needed to complete the project.

The Pool Capital Improvement Fund has been wholly funded from Pool Commission Revenues.

I have reviewed the Pool Commissions finances, and agree with the fact that the Pool will still be carrying a surplus in operations despite this additional financial commitment necessary to maintain infrastructure at the facility. The “reserve study” for the pool indicates that there are no large repair items looming; this should allow further reserves to build for multiple years to fund future infrastructure maintenance. $120K will be deducted from the Pool Operating surplus to replace the funds used from the Township’s Capital Improvement Fund.
