Month-to-Month Rental Agreement

Dated March 10, 2010

Agreement between ______, Owner, and ______, Tenant, for apartment #____, a dwelling located at 2112 Dupont Avenue South, Minneapolis, MN. Tenant agrees to rent this dwelling on a month-to-month basis for $_____, payable in advance on the 1st day of every calendar month to the Owner, whose address is 2112 Dupont Avenue South, Apartment #2. When rent is paid after the 5th day of the calendar month, a 5% late fee will be charged, and an additional 2.5% will be charged for every 5 days thereafter. If Tenant chooses to install a window air conditioning unit, rent will be increased by a $20 per month electricity charge. If Tenant chooses to install an electric space heater, rent will be increased by a $20 per month electricity charge.

The security/cleaning deposit for this dwelling is $____ It is refundable if Tenants leave the dwelling reasonably clean and undamaged.

Tenants will give 60 days notice in writing before they move and will be responsible for paying rent through the end of this notice period or until another tenant approved by the Owner has moved in, whichever comes first.

Owner will refund all deposits due within 21 days after Tenants have moved out completely and returned their keys.

Only the following 1 person is to live in this dwelling: ______. Tenant may house any single guest for a maximum period of 14 days every six months. Without Owner’s prior written permission, no other pets may stay there, nor may the dwelling be sublet or used for business purposes.

Tenants agree to the following:

  1. To accept the dwelling ‘as is,’ having already inspected it.
  2. To keep yards and garbage areas clean.
  3. To keep from making loud noises and disturbances between the hours of 11 P.M. and 8 A.M.
  4. Not to paint or alter the dwelling without first getting the Owner’s permission.
  5. To allow Owner to inspect the dwelling, work on it, or show it to prospective tenants at any and all reasonable times.
  6. Not to keep any liquid-filled furniture in this dwelling.
  7. To pay rent by check or money order made out to Owner.
  8. To pay for repair of all damages, including drain stoppages, they or their tenants have caused.
  9. To abide by smoke-free policy. No smoking is allowed in any units or any indoor common spaces.
  10. To pay for any windows broken in their dwelling while they live there.

Violation of any part of this Agreement or nonpayment of rent when due shall be cause for eviction under applicable sections of the code. The prevailing party shall not recover attorney’s fees involved.

Tenant hereby acknowledges that they have read this Agreement, understand it, agree to it, and have been given a copy.
