ORDINANCE NO. 9468 (NEW SERIES)

AN ORDINANCE AMENDING SECTION 731 OF THE COUNTY ADMINISTRATIVE CODE RELATING TO MEMBERSHIP AND SELECTION OF THE PALOMAR AIRPORT ADVISORY COMMITTEE

The Board of Supervisors of the County of San Diego ordains as follows:

Section 1. Purpose. The purpose of this Ordinance is to restructure the membership and selection of the Palomar Airport Advisory Committee in accordance with the AN ORDINANCE ADJUSTING THE BOUNDARIES OF SUPERVISORIAL DISTRICTS AND REDEFINING THE BOUNDARIES OF ALL SUPERVISORIAL DISTRICTS OF THE COUNTY OF SAN DIEGO, adopted by the Board of Supervisors on July 31, 2001 (18). The new boundaries are structured such that the entirety of McClellan Palomar Airport is now located in District 5.

Section 2. Sections 731 and 732 of the County of San Diego Administrative Code are hereby amended to read as follows:

SEC. 731. MEMBERSHIP AND SELECTION.

The Committee shall consist of eleven (11) members. The eleven members shall be nominated by the Supervisor from the Fifth Supervisorial District and appointed by the Board of Supervisors. These members shall include at least one (1) member from each of the following cities: Carlsbad, Vista, San Marcos and Oceanside and six (6) members shall be from the general public who reside within Supervisorial District 5. The remaining eleventh member shall be a member of the Noise Control Hearing Board. No more than three members of the committee shall be financially interested in any business having a leasehold interest in Palomar Airport. All members serving on the effective date of the ordinance amending this section whose appointments were made by the nomination of the Supervisor from the Third Supervisorial District shall serve out their remaining terms.

SEC. 732. TERM OF OFFICE.

Each member of the Committee shall serve a term which shall run concurrently with the term of the Supervisor who nominated them to the committee. The term shall expire on the date of expiration of the term of the nominating Supervisor, or at such time as he or she ceases to hold office, whichever first occurs. The reelection of the nominating Supervisor for a succeeding term shall not automatically extend the term of any Committee member.

Section 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after the date of its passage, and before the expiration of fifteen (15) days after its passage, a summary shall be published once with the names of the members voting for and against the same in the San Diego Commerce, a newspaper of general circulation published in the County of San Diego.
