Call to Order and Roll Call:
- Patrice Scott opened the meeting at 7:05PM and took roll call of the members present.
Approval of Minutes 10-3-2017:
- Butch Cushing made a motion to approve the October 3, 2017 minutes;seconded by Tom McGlauflin. All in favor.
Request For Re-Hearing:
- Case # 107-056 VAR 10-3-17 Request for Variance from Article IV, Section 406 (A) – Lots in Two Zones – to allow one aspect of a commercial service (garaging of commercial vehicles and light maintenance) to be co-located with a single family home. The home and garage are to be located in the Agricultural Zone. THIS CASE WAS HEARD AND THE VARIANCE DENIED AT THE OCTOBER 3, 2017 PUBLIC HEARING.
SHOULD THE REQUEST BE GRANTED, THE BOARD MAY SCHEDULE THE HEARING FOR THE NEXT REGULAR MEETING (12-5-17), OR AT A DATE THAT MEETS THE PUBLIC AND ABUTTER NOTICE REQUIREMENTS (NO LESS THAN FIVE DAYS PRIOR TO THE HEARING DATE).
- Patrice Scott explained the appeal process as it pertains to not having a full board. There had been a procedural error at the hearing.The applicants have the choice of accepting a decision from a board that is at minimum quorum, but would waive the right to the procedural issue;or they can preserve the right to appeal all.
- Tom McGlauflin made a motion; seconded by Butch Cushing, to grant a rehearing. All in favor.
- Date for rehearing is to be determined. Brian Murphy will make sure that all four board members will be able to attend.
New Business:
- Patrice Scott stated that the board received a letter of resignation from Freeman Plummer. She thanked Freeman for volunteering to be on the Zoning Board and thanked his wife, Eleanor for representing the public at these meetings.
- Patrice Scott made a motion; seconded byTom McGlauflin to seek counsel in regard to holding a rehearing the same evening, once a rehearing is granted, provided abutter and public notice requirements are met and accompanied by a statement that if the rehearing is approved, the case will be held that night. All in favor.
Adjournment:
- Tom McGlauflin made a motion to adjourn, seconded by Butch Cushing. All in favor.
- Patrice Scott adjourned the meeting at 7:20 PM.
