allthecircumstancesareexaminedinrelationtohisemploymentitcan beseenthatthereisnotacasefortheclaimthatheisasub-contractor.
Thereisnosub-contractagreementandthisisaspecificrequirementofAustraliaPostiftheheadcontractorwishestosub-contractouthiswork. MrVermaprovidedonlyhislabour.MrPereraprovidedallnecessaryequipment- thevehicle,insurances,scannerandother toolsoftrade.
MrPereradirectedthewayinwhichMrVermaperformedhiswork.ItwasnotpossibleforMrVermatogetotherpeopletosub-contractoremployotherstodohiswork,partlybecausetheywould requiresecuritypassesorclearancesfromAustraliaPostwhich areprovidedatthediscretionofAustraliaPostandeventhenonlyonMrPerera'srequest.MrPereraisresponsibletoAustraliaPostintheeventthathisemployeesdonotachievetherequiredperformancestandards.
MrVermaappliedforemploymentof 4Xhoursperdayasheisastudentwithwork
restrictions.
ThefactsofthematteristhatMrPererawasshort-staffedandinsistedonMrVermadeliveringtwopostieroundswhichis aphysicalimpossibility.WhenMrVermatoldMrPererathathecouldnotdeliverallthemailinthesameday,MrPererainstructedMrVermatostorethemail.Pleasefindenclosedanemailexchangethatverifiesthisclaim.MrVerma
becameconcernedaboutthedelayedmailandafterseekingadvicefromanotherheadcontractorinformedtheNarreWarrenDeliveryCentreManager.IpersonallyhaveconfirmedthatthiswasthecasewiththeDeliveryManager.

In2000,AustraliaPostcontractedoutmostoftheirparceldeliveriestoindividualhouseholdssmallbusiness. Therearenowover1,000parcelcontractorsinVictoria.When'Parcels'werefirstcontractedout,theaveragepricepaidtothedriverperparcelwasabout$1.50perparcel,thisnowhasbeenreducedto$1.10.Somedriversget$1.35,andsomenewerdriversareon 95centsperparcel,andeven80centsperparcelswhenthecontractorprovidesthevan.Somecontractorswhoareindifficultareasandwhohavebusinessacumencangetratesof$1.75or morebuttheseareexceptionstotherule.
Thereareavarietyofarrangements-somesoleoperators,somewhoemploy2or3driversandsomelargeoperatorswhoemploy20-100drivers.Somedriversprovidetheirownvanswhilevehiclesareprovidedforothersbytheheadcontractor.
ItiscommonforAustraliaPosttobetardywithpayingforincreasesinvolumesorpointsdeliveredto.
Ingrowthareas,AustraliaPostgettheadvantage ofthefactthatthetenderdocumentandthe volumecountisdonemonthsbeforeitistendered,thenthenewcontractorhastoworkoutthemechanismbywhichyougetanincreaseinpriceifthenumberofhouseholdsservicedhasgrown,thentheyhavetogetaresponsefromtheContractCentre.
Similarly,AustraliaPostwillpressureexistingcontractorsadjacenttonewly developedestatesorLPOsthathavegoneoutofbusinesstotakeonthatadjacentwork,theywillthenhavethe contractordoingtheworkwithoutanypaywhiletheytakemonthstonegotiateaprice.Theywillalsopressurethemtotakeovercontractsthathavefallenover,givingthemthesameorconsignedpricewhichhadprovedtobeinadequate.Clause9.3oftheStandardContractprovidesthattheycannotgetanincreaseunlesstheirdeliverypointsincreaseby20inrespecttoStreetMailDeliveryand10inrespecttoRoadsideDelivery.
Acontractorcanchoosebetweenobtainingapercentageprofitforthelifeofthecontractor receivingCPIincreases. TheseCPIincreasesare notautomaticandareonlybackdated tothetimeofrequest.
AustraliaPosthasclauses(89)thatallowthemtoadjustpricesdownwardsiftheycomeupwithaninitiativethatleadstocostsavings.AustraliaPosthavecomeupwithsuchinitiativesthemostinfamousistheconsignmentprice-thedrivergetparcelslabelled,forexample,1of
20.Thesemaybewine,paper,cartonsofbooksandfilltheirvansupandneedtobecarriedupflightsofstairs,etc.Thedriversget,forexample,$1.10forthefirstoneand70centsforeveryotherone.
Increasinglycontractorsareexpectedtodeliverparcelsinexcessof 32kgs.
Theunionhasdiscoveredallsortsofexamplesofpoorpayandconditions.TherewasawholegroupofdriversatBendigowhowerebeingemployedontraineewageswhichgiventhatthey heldandusedadriver'slicenseintheirworkwasjustabizarrewayofreducingtheirpayrate.

ShehasanABNanACN.InFebruary2009,shecontractedtoperformthisservicefor$61,740.22centsor$67,914.24whenGSTwasincluded.Itwasestimatedthatitwouldtakeher36.25hoursperweekandthewagerateinthetenderwas$19.50anhourwithnoreliefprovisionbutanadditionalamountforSuperannuationWorker's Compensation.
Theworkinvolvestravelling294.7kmsperdayor73,675kmsperannum.
InMarch2011,CwasaskedtocoversomeextraworkastheresultoftheGarvocLPOclosure.Cdid notagreethatthepriceofferedwasfair.Areviewoftheactualworkandthetimetakenwasconductedbetween25Julyand5August2011.Thiswasdiscountedforbreaksthatshedidnottake.
Shewasthreatenedthatifshedidnotdotheextraworkthatheroriginalcontractwouldbe
takenoffherbyanAustraliaPostAreaManager.
Shecontactedtheunionandtheunionbecameheragentandputthematterintodispute. The unionputinaclaimusingtherealtimetakenandawagerateattheMinimumWageundertheRoadTransportandDistributionWorkersAward. WealsoreviewedherpastpaymentsandworkedoutwhetherCPIandpaymentsforpastVariationshadbeenmade.
ItisextraordinarilydifficulttounderstandAustraliaPost'spaymentreceiptsastheylackdetails.Aletterofdisputewaslodged,andextrainformationrequested. Therewerenumerousphonecallsandeventuallyameetingtime wasmade.Thishoweverwascancelled,andsubsequentphonecallsandemailswereignored. Itwasonly12monthslaterfollowinganappealtoseniormanagementthatatelephonemeetingoccurredandanagreementwasreachedtoundertakeanotherreviewtotrytosorttheissueout.
Thisreviewhasyettooccur.
