F.3.a. C Bylaw 12366 - Smoking Bylaw Amendment No. 9. Ø

MOVED M. Phair:

1.  That the June 20, 2000 Edmonton Police Services (Bylaw) report (item D.2.a.) and the October 2, 2000 Edmonton Police Service report (item F.3.a. C) be postponed to the November 14, 2000 Community Services Committee meeting at 1:30 p.m.
2.  That the Administration provide for the November 14, 2000 Community Services Committee meeting information from the Provincial Government regarding legislation allowing minors on bingo premises.
3.  That the Administration prepare a report in response to the following questions:
·  Can a specific requirement to separate lounges from restaurants that are contained in the same area be included in the amendment?
·  With respect to restaurants with an attached lounge area, what kind of separation would be required between the restaurant and the lounge?
·  Can alternate wording that would require Bingo establishments to allow only “18 years and over” on the premises be included in the amendment?
·  Can “Casinos” be eliminated from the proposed amendment?
·  Can wording for the amendment be included that would make the proprietor responsible for reporting and enforcing violations of the “no smoking” rule for restaurants?
·  Can the “Place of Employment” [Workplace] be defined?
·  When someone states that restaurants are public buildings in terms of public health requirements, do the regulatory powers extend to controlling the behaviour of the customers? For example, public health regulates cleanliness of the food preparation area, requirement for employees to engage in personal hygiene practices while handling the food, temperature of the food, etc. Has public health ever regulated the behaviour of the customers?
·  What would be the ramifications, and what would be necessary to draft an amendment that required restaurant owners to declare their establishment “smoking” or “non-smoking”?
·  What would be required to draft an amendment which afforded restaurant owners to declare their establishment “adult only with smoking allowed”?
·  If casinos were subsequently not included in the amendment, what restrictions would be placed on the restaurant areas of the premises?
·  Is there any way regular bingo halls, namely, buildings which are designed to hold bingos and where bingo is their chief form of business, can be distinguished from other establishments, like churches or community league halls, where the occasional game of bingo is played? Would it be possible to exclude the latter from the requirements of this bylaw?
·  Are any problems anticipated relative to making the non-smoking and smoking areas contiguous within gaming establishments? Could it be ensured that it only pertains to the gaming area, so that it would not require separate entranceways, washrooms or food concessions?
·  Should the definition of “smoking room” be changed to ensure that it prevents smoke from escaping and entering the rest of the premises?
