L.BYLAWS

L.1.a.Bylaw 12496 – To Amend the Land Use Bylaw from AG (Agricultural) District (County of Strathcona) to RSL (Residential Small Lot) District, RA7 (Low Rise Apartment) District and PU (Public Utility) District; Located at 8661 Ellerslie Road SW, Summerside.

PURPOSE

To allow single family detached housing and low rise apartment development, as well as a utility corridor.

L. Gibson, Carma Developers, was in attendance to answer questions in favour of the passing of Bylaw 12496.

Mayor B. Smith asked if there was any objection to Bylaws 12497 and 12498 being dealt with together. No one responded.

L.1.b.Bylaw 12497 – To Amend Bylaw 11705, being the Blackmud Creek Neighbourhood Area Structure Plan.

PURPOSE

To amend the Blackmud Creek Neighbourhood Area Structure Plan (NASP). The proposed amendment redesignates the Ellerslie Road Baptist Church site and a portion of a park site (formerly the Klondike Valley Sewage Lagoon) to an Urban Services designation.

L.1.c.Bylaw 12498 – To Amend the Land Use Bylaw from AG (Agricultural) District (County of Strathcona) and CR (Country Residential) District (County of Strathcona) to US (Urban Services) District and A (Metropolitan Recreation) District; Located West of Blackmud Creek and South of 9 Avenue SW (Ellerslie Road), Blackmud Creek.

PURPOSE

To allow urban service uses and a park.

There were no persons present to speak to the passing of Bylaws 12497 and 12498.

L.1.d.Bylaw 12501 – To Close Portions of 185 Street, 190 Street and 106 Avenue, Located North of 105 Avenue and West of 184 Street, Poundmaker Industrial.

PURPOSE

To close portions of 185 Street, 190 Street and 106 Avenue. Once closed, the area will be consolidated with Lots 1 to 18, Block 1, Plan 812 2189 and Lots 1 to 14, Block 2, Plan 812 2189.

There were no persons present to speak to the passing of Bylaw 12501.

Mayor B. Smith asked if there was any objection to Bylaws 12457 and 12458 being dealt with together. No one responded.

L.1.e.Bylaw 12457 – To Amend Bylaw 7469, As Amended, being the West Ingle Area Redevelopment Plan.

PURPOSE

To amend the West Ingle Area Redevelopment Plan. The proposed amendment will reflect the redistricting of Lot 21, Block 1, Plan 922 1928; Lot 53, Block RLY, Plan CNR9; Lot 18, Block 8, Plan RN22; Lots 19 and 20, Block 8, Plan RN22; OT Parcel, Plan RN22, from CB2 to RA8.

L.1.f.Bylaw 12458 – To Amend the Land Use Bylaw from CB2 (General Business) District to RA8 (Medium Rise Apartment) District, Located South of 106 Avenue and West of 121 Street, Westmount.

PURPOSE

To allow the development of medium density apartment housing and residential related uses on the site.

M. Pankiw, IBI Group, was in attendance to answer questions in favour of the passing of Bylaws 12457 and 12458.

L.1.b.Bylaw 12497 – To Amend Bylaw 11705, being the Blackmud Creek Neighbourhood Area Structure Plan.

L.1.c.Bylaw 12498 – To Amend the Land Use Bylaw from AG (Agricultural) District (County of Strathcona) and CR (Country Residential) District (County of Strathcona) to US (Urban Services) District and A (Metropolitan Recreation) District; Located West of Blackmud Creek and South of 9 Avenue SW (Ellerslie Road), Blackmud Creek.

L.1.g.Bylaw 12362 - To Amend the Land Use Bylaw from AG(Agricultural) District (County of Strathcona) to DC5 (Site Specific Development Control) District and A (Metropolitan Recreation) District; located north of Ellerslie Road and east of 184 Street, Rural South West. 

PURPOSE

To allow for single detached housing on large lots and apply the appropriate designation to the lands within the North Saskatchewan River Valley and below the top-of-the-bank.

L.1.h.Bylaw 12411 – To Amend the Land Use Bylaw from AG (Agricultural) District (County of Strathcona) to RR (Rural Residential) District; Located East of 66Street and North of Ellerslie Road, Rural South East. 

PURPOSE

To allow single detached residential development without the provision of the full range of urban utility services.

There were no persons present to speak to the passing of Bylaw 12411.

L.1.i.Bylaw 12485 - To Amend the Land Use Bylaw from CNC (Neighbourhood Convenience Commercial) District to DC5 (Site Specific Development Control) District; Located at 6610 – 86 Street, Argyll. 

PURPOSE

To allow Convenience Commercial and Personal Service uses which are tended to serve the day-to-day needs of residents within the Argyll neighbourhood, along with General Retail uses and an Automotive and Minor Recreational Vehicle Rentals business (U-Haul rental) which would be accessory to a Convenience Retail Store.

B. Levojevic; D. Baragar and M. Leedham were in attendance to speak in opposition to the passing of Bylaw 12485.

Mayor B. Smith asked if there was any objection to Bylaws 12504 and 12505 being dealt with together. No one responded.

L.1.j.Bylaw 12504 – To Amend Bylaw 7469, As Amended, being the West Ingle Area Redevelopment Plan.

PURPOSE

To amend the West Ingle Area Redevelopment Plan (ARP). The proposed amendment will reflect the associated redistricting of Lots 12 and 13, Block 29, Plan 7920201 from CNC to DC5, proposed under Bylaw 12505.

L.1.k.Bylaw 12505 – To Amend the Land Use Bylaw from CNC (Neighbourhood Convenience Commercial) District to DC5 (Site Specific Development Control) District; Located East of Groat Road and South of 111 Avenue, Westmount. 

PURPOSE

To amend the Land Use Bylaw as it applies to this site from CNC to DC5. The proposed DC5 District is based on the CNC District with the addition of Minor Alcohol Sales and the deletion of Apartment Housing and Child Care Services. The CNC regulation restricting individual business size to 275 m2 (except for Second Hand Stores) is also deleted.

R. Kreutz was in attendance to answer questions in favour of the passing of Bylaws 12504 and 12505.

L.1.l.Bylaw 12494 - To Amend the Land Use Bylaw from DC5 (Site Specific Development Control) District to DC5 (Site Specific Development Control) District, Located at the Northeast Corner of 160 Avenue and 84 Street, Belle Rive. 

PURPOSE

To add three additional uses “Minor Alcohol Sales,” “Government Services,” and “Business Support Services” to the listed uses presently allowed for the site.

J. Andrew, Scheffer Andrew Ltd., was in attendance to speak in favour of the passing of Bylaw 12494.

L.1.h.Bylaw 12411 – To Amend the Land Use Bylaw from AG (Agricultural) District (County of Strathcona) to RR (Rural Residential) District; Located East of 66Street and North of Ellerslie Road, Rural South East.

J.A. Bryan made a presentation. Photographs of the proposed development were distributed to Members of Council and filed with the Office of the City Clerk. G. Cantalini, J.A. Bryan and
M. Pankiw answered Council’s questions. A copy of a letter dated February 5, 2001 from
M. Doesburg, m. doesburg developments ltd., regarding large rural lots was also distributed to Members of Council and filed with the Office of the City Clerk.

D. Hackman and R. Mackenzie made presentations and answered Council’s questions.

J. Watts made a presentation and answered Council’s questions. A copy of a survey of the homeowners on Windermere Drive regarding the proposed Bylaw 12362 was circulated to Members of Council and filed with the Office of the City Clerk. A copy of a letter from
G.R. Keen and A.M. Keen, property owners, was distributed to Members of Council and filed with the Office of the City Clerk.

Councillor J. Taylor left the meeting at 3:00 p.m. and re-entered a few minutes later.

Councillor D. Thiele left the meeting at 3:09 p.m. and re-entered a few minutes later.

Councillor T. Cavanagh left the meeting at 3:13 p.m. and re-entered a few minutes later.
