In consideration or your allowing us to remove the above-mentioned import loaded full containers to our premises. The undersigned hereby undertake and guarantee you the following:
1. We shall at our cost and risk removes the above container/s (after payment of Custom Duty)
from nominated to our premises situated at ______return the same to
your storage yard within on month from the date of its removal.
2. We shall at our cost arrange to survey the container/s by your surveyors before removal from
nominated site and after returning at your storage yard. In case any damage is noticed while
removing the loaded container/s from respective ICD, We Shall arrange to get a joint survey
arranged at our own cost, before removal of container/s.
3. We shall at our cost arrange to survey the container/s and we shall pay the repair cost of damage as estranged by your surveyors while the container was in our custody.
4. We shall pay you the container detention and other charges as and when demanded by you.
5. In case we fail to return the container/s within one month from the date of removal, we shall
obtain necessary permission from you and Customs Authorities to retain the container with us
beyond 30 days.
6. In case the container/s is/are lost while in our custody, we shall pay you the cost of container/s
and the customs duty applicable on the container/s Rs. 2,53,000/- approx. per 20’ and Rs.
4,21,000/- per 40’ container.
7. We shall produce the original triplicate copy of Bill of Entry duly endorsed by Customs within
7 days from the returning the container/s along the survey reports.
8. We shall keep you and the carrier completely indemnified and harmless from and against all
consequences, which may arise from complying with our respect.
9. This bond will remain in force till such time we comply with our above undertaking and fulfill
all your/customs authorities requirements.
10. We hereby confirm that the Import cargo does not contain any contraband article in terms of
Indian Regulation and that the shipper has not tampered with container(s) for the purpose of
concealment of any contraband cargo. In the event Customs or any other Authority discover that
there has been violation in this respect, we as consignee of this cargo would fully responsible for
the container & would take 5 days to return the container(s) back to your empty storage yard
after from the removal from the nominated site.
11. Consequent to the movement of the container(s) to the factory, we hereby indemnify the carrier
and their assigned agents towards any loss, damages, liability, cost of expense suffered and
incurred by the movement of the said container under your jurisdiction arising out of damage to
the property of other person arising out of the use/ operation maintenances in the possession of
carrier container(s) by the consignee or his authorized representative.
