Tier II Reporting
Reporting Deadline is MARCH 1, 2006
The Lowndes County LEPC is requesting all facilities in Lowndes County Mississippi with ECPRA listed chemicals in reportable quantities to submit their Tier II reports to the LEPC by March 1, 2006 based on the facilities inventories during 2005. This is an EPA requirement under Emergency Planning and Community Right to Know Act. More information is available on the EPA’s website. The Lowndes County LEPC has a website with links for downloading the reporting forms used by the LEPC at with links to the EPA’s website for the free software used for generating the Tier II reports. This makes the yearly reporting very easy to update.
The LEPC is in the process of rewriting the Lowndes County Emergency Plan, as a result, we are requiring all facilities covered under the EPCRA regulation to file a Tier II report. Retail fuel facilities MUST report their fuel inventories for 2005. We request but do not require electronic reporting using the EPA’s Tier II Submit software package. Facilities failing to report their Tier II chemicals by March 1st can be referred to the EPA for enforcement actions. Enforcement actions by the EPA can result in fines of up to $25,000 per day for each chemical not reported. The LEPC is not interested in getting companies fined, but we are interested in accurate reporting of the hazards in our community for emergency planning purposes.
Please review your facilities chemical inventory against the EPA’s List of List to see if your chemicals are reportable to the LEPC.
Tier II reports for facilities in LowndesCounty must be submitted to the Mississippi Emergency Management Agency, Lowndes County LEPC and the Fire Department having jurisdiction over the facility. Mississippi Emergency Management Agency and the Lowndes County LEPC are accepting electronic submittals of the Tier II Submit data files generated from the EPA’s Tier II Submit 2005 program. Paper copies of the Tier II reports can also be generated by the software for paper submittals to the above listed agencies. Please remember that an original signature is required on the first page of each submittal in order to comply with the EPA’s regulation. Photocopies of the signature are invalid and may result in enforcement actions. The LEPC’s website has the e-mail addresses and mail addresses for the different agencies accepting Tier II reports.

The LEPC is rewriting the Emergency Plan this year and request each facility submit updated 302 notifications and facility information sheets and facility contact sheets. Some facilities are required to submit list of all chemical that have an MSDS and to submit their Emergency Response Plans to the LEPC. The Lowndes County LEPC request this information be updated and submitted electronically to the LEPC when possible. Please e-mail these files to the address . The LEPC membership voted to assess a voluntary reporting fee to each facility based on facility Tier II reports to cover the cost of printing and distributing the updated Emergency Plan. Please review the December 2005 minutes for more information.
