HIRSCHLER FLEISCHER EXPANDS ITS BANKRUPTCY PRACTICE

Richmond, Va.—Hirschler Fleischer has expanded its bankruptcy practice with the addition of two seasoned bankruptcy attorneys, David K. Spiro and Robert S. Westermann, who have joined the firm as partners.Practice services include business reorganizations, workouts, creditors' rights in and out of bankruptcy, receiverships, and all related commercial litigation.

“David and Robbie join Richmond office partner Michael P. Falzone and Fredericksburg office partner Gary M. Nuckols, as well as a host of associates, in an expanding bankruptcy practice in light of the economic downturn,” states James L. Weinberg, the firm’s President. “David and Robbie add a wealth of experience, knowledge, and expertiseto our bankruptcy group.”

David Spiro’s practice focuses on general bankruptcy matters, with an emphasis on the representation of distressed businesses and business owners. In addition to his debtor practice, Mr. Spiro routinely represents lenders, developers, landlords and other entities as creditors in bankruptcy and workout proceedings.He has served as court-appointed receiver for a variety of Virginia corporations, has represented unsecured creditors' committees and trustees in Chapter 11 and other bankruptcy proceedings, and has achieved dozens of confirmed plans of reorganization.

In 2004, Mr. Spiro earned his certification in business bankruptcy law from the American Board of Certification, an affiliate of the American Bankruptcy Institute*. He has attained the AV peer rating from Martindale-Hubbell, its highest rating, and was named to Virginia Business Magazine's "Legal Elite" for 2007 and 2008.Formerly with Cantor Arkema, P.C., he was that firm’s Bankruptcy Section Chair.

Robbie Westermann’s practice focuses on bankruptcy law, general commercial litigation with an emphasis on the representation of lenders, and creditors’ and debtors’ rights. He has represented Chapter 11 debtors and trustees in many different industries and specialties, as well as other constituents in bankruptcy cases including lenders, secured creditors, landlords, and suppliers of goods and services. His experience also includes the representation of nationwide commercial and consumer lenders in both federal and state courts throughout the Southeast, including defense of class actions, defense of claims under federal statutes including TILA, FDCPA, and FCRA, and defense of state law claims.

Upon graduation from law school, Mr. Westermann served as a Law Clerk to the Honorable Blackwell N. Shelley, U.S. Bankruptcy Court, Eastern District of Virginia, from 1998-1999.Prior to joining Hirschler Fleischer, he was counsel at the AmLaw 100 firm Hunton & Williams LLP.
