Participation Contract

Period of Agreement: According to the following terms and conditions, the Artist agrees to participate in the Agent’s (Beacon Original Art) art exhibition and sale to be held at:

Saturday April 21, 2018 from 10:00am until 4:00pm

1) Ownership: All artwork displayed in the exhibition remains the property of the Artist until sold and paid for in full by a purchaser. Once the piece is paid for in full, title passes from the Artist to the purchaser. Any copyright to the artwork remains with the Artist unless otherwise arranged by the Artist.

2) Commission and Fees: Upon acceptance into the above specified exhibition and sale, a fixed and non-refundable fee of $100.00 will be paid by the Artist to the Agent. Payment of the $100.00 fee allows the Artist to share exhibition space with other participating artists as directed by the Agent. A commission of 20% will be deducted by the Agent from the Artist’s gross sale proceeds and will be retained by the Agent. The Agent will not pay commission or replacement value on artwork claimed to be lost or stolen. Lost or stolen artwork is not the responsibility of the Agent.

3) Sales: Payment to the Artist will be made within 30 (thirty) days following the date of the exhibition and sale. The Agent shall forward to the Artist an amount equal to the total selling price of the sold artwork, minus the Agent’s commission of 20%.

4) GST: The Agent will not carry out collection and submission of GST. Calculation and submission of GST on the Artist’s sales, is the sole responsibility of the Artist.

5) Insurance: The Artist is responsible for providing their own insurance for their artwork and belongings, for all perils, for the duration of the exhibition and sale, including set-up, takedown and clean up. The agent will not be held responsible for injury to the Artist or loss, theft or damage to artwork, related items or personal belongings.

6) Pricing/Inventory: Pricing of the artwork is the sole responsibility of the Artist and once set will not be changed or discounted for the duration of the exhibition and sale.

A detailed inventory will be submitted to the Agent in only Microsoft Excel format on or before Saturday March 31, 2018. Only artwork included in the inventory list will be permitted for exhibition.

7) Price Labels: The Agent will provide labels only to Painters and Photographers (single medium) to be attached to each piece of artwork (jewelers, potters, textile, multiple mediums, etc. will provide their own labels). Artists are required to review the labels and inform the Agent at the set-up of show of any errors. Once labels are verified and attached to artwork on sale day, label changes will not be permitted.

8) Warranty: The artist warrants that he or she is the sole creator of the artwork submitted and owns copyright to the artwork. Deficiencies in the integrity, durability and/or quality of artwork sold at the exhibition are the sole responsibility of the Artist.

9) Advertising: The Agent reserves the right to use submitted images from the Artists for ongoing promotional materials.

10) Acceptance of Work: The Agent reserves the right to remove any artwork or related items or materials, which may be deemed inappropriate without notice or appeals. These items will be removed from the exhibition area and returned to the Artist.

11) Abandon Artwork: Attempts will be made to ensure that Artists claim all artwork and display furniture at the end of the sale day. Any artwork or items left unclaimed for a period of 30 days will become the property of the Agent.

12) Event Participation: The Artist is required to be in attendance at the exhibition for its entire duration. It is expected that the Artist will participate in set-up, takedown and clean up, as well as perform assigned duties on the day of the exhibition. If the Artist is not able to attend, the Artist’s work will not be included in the exhibition and sale. It is expected that the Artist’s attire, attitude and behaviour will remain professional during the exhibition and sale. The artist should not bring an artist binder, banner or promotional material for future shows as the focus is only on selling the art exhibited on the day of the sale. Artists should bring their own business cards.

·  Submission of this form is a statement of your acceptance and agreement with Beacon Original Art’s terms and conditions.

·  Accepted applicants will be notified by e-mail and will be asked to submit their non-refundable participation fee of $100.00. If payment is not received within two weeks of notification, the artist must reapply as their tentative spot will be forfeited.

·  Once an artist’s non-refundable $100.00 participation fee is received, they are guaranteed a spot in the show.

·  Incomplete submissions will not be processed.
