POLICY TITLE: Facility Use Agreement

PURPOSE:

The Summit Fire Authority / High Country Training Facility located at 0225 County Road 1003 Frisco, CO 80443 can be made available for public use when the date requested does not conflict with any Summit County Fire Department activities or operations.

Conditions to use the High Country Training Facility by the public are as follows:

1.1 All scheduling for the High Country Training Facility is to be done by contacting the SFA office at 970-668-4330. A Facility Use Agreement form must be completed by the requesting user prior to first date of usage. Approval will be made on a case by case basis. Signups for regular, recurring monthly meetings are limited to no more than six months at a time. Regular, recurring weekly meetings will be reviewed and approved on a case by case basis.

1.2 The High Country Training Facility may be used for open public meetings, civic group meetings and functions, classes, presentations and workshops. High Country Training Facility reserves the right to deny any and all requests.

1.3 The intended use of the facility must be clearly stated on the Facility Use Agreement.

1.4 The user signing the Facility Use Agreement shall assume responsibility for any and all damage of the facilities, grounds, or equipment as a result of the use of the facility. Any furnishings moved or rearranged during the use of the facility shall be replaced and all trash removed prior to vacating the building. Cleanup fees may be assessed.

1.5 The appropriate notations must be made on the Facility Use Agreement if food is to be served, prepared, cooked or brought into the facility. Normal coffee and snack service is acceptable. The High Country Training Facility does not provide cups, coffee, plates, utensils, and all items in either of the two refrigerators are off limits.

1.6 Use of the High Country Training Facility is restricted to the classroom and public restrooms. i.e. Entry into the offices is prohibited; and children shall not be permitted inside or outside of the building without adult supervision.

1.7 Hours of Operations of the High Country Training Center Facility are 7 am to 10 pm

1.8 It is the responsibility of the User to come fully prepared for their event; the High Country Training Facility does NOT offer photocopying, facsimile or other office function services.

1.9 The High Country Training Facility reserves the right to cancel a reservation if the room is needed for Fire Department use. However, every effort will be made to give adequate, advanced notice. Emergency operations take precedence over any scheduled event.

1.10 Use of tobacco or tobacco products on the High Country Training Facility is prohibited.

1.11 The use of alcoholic beverages in the facility or on the Fire District grounds is prohibited.

1.12 High Country Training Facility classroom capacity for public use is seventy one (71) people

1.13 The High Country Training Facility holds no liability for User’s property damage. The User waives any and all claims, suits and causes of action against the High Country Training Facility (including all staff and Fire Districts) for any property loss or damage done to the User’s property, whether real, personal or mixed, occasioned by the User’s activities at the Facility. It shall be the User’s responsibility to provide its own protection against casualty losses of any kind or nature, regardless of whether or not such loss is occasioned by the acts or omissions of the High Country Training Facility, the User, third party, or act of nature. Read and sign the attached release and indemnity agreement.

1.14 Any violation of these policies may cause cancellation of a group’s privileges for further facility use.

1.15 The High Country Training Facility reserves the right to make final determination of the “appropriate use” concept.

A $25 per hour setup and cleaning fee may be assessed for any additional time needed to clean up or re-set the classroom.

Release and Indemnity Agreement

HIGH COUNTRY TRAINING CENTER

THIS IS A RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT.

READ IT CAREFULLY AND COMPLETELY BEFORE SIGNING.

ACTIVITY PARTICIPATION ASSUMPTION OF RISK,

RELEASE, WAIVER, DISCHARGE, AND INDEMNIFICATION

______(name of individual or organization) on behalf of myself, my spouse, legal representatives, heirs and assigns, if Releasor is an individual, and it, its officers, employees, volunteers and agents, if Releasor is an organization (collectively referred to as "Releasor"), has requested permission to use the High Country Training Center or participate in training exercises or activities at the High Country Training Center, and in consideration therefore agrees to the following:

1 Condition of Participation and Acknowledgement of Risks. Releasor agrees that this Agreement is given in consideration of being permitted to participate in the activity identified above, and has been fully informed of the nature of the abovelisted activity and the risks inherent in participating in such activity. Releasor has the opportunity to inspect the activity venue prior to participating in the activity and that the Releasor assumes the risks of all activity venues conditions. Releasor understands such activity may involve exercise or physical exertion of varying degrees of difficulty, which may be strenuous and taxing both physically and mentally. Releasor further understands that by participating in this activity Releasor runs the risk of physical injury, internal and external, temporary or permanent, or the risk of death, and may run the risk of developing mental stress.

2. Assumption of Risk. Releasor has independently evaluated and reviewed the risks and determined to engage in the abovelisted activity with full knowledge and acceptance of the risk. Fully understanding these risks, Releasor hereby agrees to assume full responsibility and liability for the risk of bodily injury (including death), or property damage which may result from participation in this activity.

3. Release. Releasor hereby waives, releases, and discharges the High Country Training Center, a/k/a Summit County Fire Training Facility; Summit County Fire Protection Authority; Joint Training Facilities Enterprise; Summit County Emergency Services Training Center, a nonprofit corporation; Copper Mountain Consolidated Metropolitan District; Lake Dillon Fire Protection District; Red, White and Blue Fire Protection District; and as to each of the previously mentioned, their officials, employees, volunteers, attorneys, and agents (collectively hereinafter the "Training Center") from any and all liability to Releasor, for any and all losses or damages resulting therefrom, on account of any injury, even injury resulting in death, or to Releasor's property, whether caused by negligence of the Training Center or otherwise, which claims, losses, and demands arise during or result directly or indirectly from participation in the subject activity.

4. Indemnification. Releasor agrees to fully indemnify and hold harmless the Training Center, from any and all losses, liabilities, damages, or costs, including reasonable attorney's fees, which may be incurred as a result of injuries to Releasor which arise from Releasor's participation in the subject activity, whether any such loss or liability was caused by the negligence of the Training Center or otherwise. Releasor further agrees to indemnify and hold harmless the Training Center for any acts or conduct of Releasor, of whatever kind or nature whatsoever, while participating in the abovelisted activity, including damages to the High Country Training Center. Releasor agrees to abide by all High Country Training Center Rules and Procedures applicable to the subject activity.

5. Extent of Release. Releasor expressly agrees that this Agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Colorado. If any portion of this Agreement is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

6. Knowledge and Consent. Releasor has carefully read this Agreement and knows and understands fully the contents. No oral representations, statements or inducements, other than the foregoing written agreement have been made.

Note: If Releasor is under 18 years of age, this Release must also be signed by a parent or a legal guardian and the parent or legal guardian acknowledges: 1) they have spoken to the minor Releasor about the activity; 2) the minor Releasor understands and appreciates the risks of participating in the activity; and 3) the minor Releasor has voluntarily decided to participate in the activity.
