ADVERTISMENT TO BIDDERS NOTICE TO BIDDERS

Notice is hereby given that sealed proposals will be received by hand delivery or by U.S. mail, addressed to the Qualified Purchasing Agent One Aberdeen Square, Aberdeen, New Jersey 07747. Public Call at 10:00 am, and thereafter unsealed and read in the Council meeting room, Aberdeen on Thursday, October 20, 2016 on or after 10:00 am prevailing time, no bids received after public call thereafter, for the following:

SNOW REMOVAL FOR MASS TRANSIT PARKING LOTS

Said Material/service is to be in accordance with the specifications, copies of which are on file in the QPA’s office, One Aberdeen Square, Aberdeen, New Jersey, 07747 and may be obtained during regular business hours.

During the performance of this contract, the Contractor shall conform with Affirmative Action regulations set forth in N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27, as amended and supplemented from time to time.

Bids must be accompanied by a certified check, cashier’s check or bid bond for 10% of the total amount of the bid, but not to exceed $20,000, made payable to the township of Aberdeen.

The successful bidder will be required to furnish satisfactory Surety Bond, in statutory form, in the full amount of the contract. Proposals must be enclosed in a sealed envelope with the bidder’s name and address and the designation of the materials/service bid noted on the outside of the envelope. The right is reserved to reject any and all bids, to increase or decrease quantities to be purchased or to waive any informality in the bids and accompanying documents received.

INSTRUCTIONS TO BIDDERS

1.  All bids must be submitted on the forms furnished by the Township for such purposes. These forms are available at the office of the Township Manager – bids not completed on the appropriate forms will not be considered.

2.  Bids must be placed in a sealed envelope addressed to the Township Manager, Township of Aberdeen Municipal Building, One Aberdeen Square, Aberdeen, New Jersey 07747. Bid packages must be submitted on the proposed bid submittal forms as provided, and in the manner designated. Bidders should also keep a complete copy of the bid packet, exactly as submitted.

3.  Bids may be hand delivered or mailed per legal notice to bidders. In the case of mailed bids, the Township assumes no responsibility for their loss in transit or bids received after the designated date and time, and will return late bids to the bidder unopened.

It is the responsibility of the bidder to ensure that their bid is presented to the Township and officially received before the advertised date and time of the bid. It is understood and agreed upon that any person in the Township will be absolved from responsibility for the premature opening of any bid not properly labeled and sealed.

4.  All prices and amounts must be written in ink or preferably machine-printed. Bids containing any conditions, omissions, unexplained erasures or alterations, items not called for in the Bid Proposal Form, attachment of additive information not required by the specifications, or irregularities of any kind, may be rejected by the Township. Any changes, white-outs, strike outs, etc. in the bid must be initialed in ink by the person signing the bid.

5.  All materials and services shall conform to the current specifications as set forth herein.

6.  The Township Manager and the Township Council reserves the right to reject any and all bids, and to waive any informalities.

7.  A certified check, cashier’s check, or bid bond drawn to the order of the Township of Aberdeen for not less than ten percent (10%) of the amount of the bid, not in excess of twenty thousand dollars ($20,000), payable unconditionally to the Township shall be submitted with the proposal as required. The successful bidder shall be required to furnish Surety Bond, in statutory form, in the full amount of the bid. The check or bond of the successful bidder shall be forfeited if the bidder fails to enter into contract. Failure to submit a bid guarantee shall result in a rejection of the bid.

8.  Bidder shall submit with the bid a Consent of Surety with Power of Attorney for the full amount of bid price from a Surety Company authorized to do business in the State of New Jersey and acceptable to the Township stating that it will provide said Bidder with a Performance Bond in the full amount of the Bid. This Certificate shall be obtained in order to confirm that the bidder to whom the contract is awarded will furnish performance and payment bonds from an acceptable Surety Company on behalf of said bidder. Failure to Consent of Surety shall result in a rejection of the Bid.

9.  N.J.S.A. 52:32-44 requires that each bidder submit proof of business registration with the bid proposal. Proof of registration shall be a copy of the Bidder’s Business Registration Certificate (BRC).

10.  The Non-Collusion Affidavit, when a part of the specifications, shall be completed and submitted with the proposal.

11.  All bidders are hereby notified that every corporation and partnership, according to the provision of Chapter33, Laws of 1977 of the State of New Jersey, must submit a statement prior to the receipt of the bid or accompanying the bid, setting forth the names and addresses of all stockholders in the corporation or partnership who own 10% or more of its stock, of any class or of all partners in the partnership, who own 10% or greater interest herein, as the case may be. If one or more such stockholder or partner is itself a corporation or partnership, the stockholder holding 10% or more of that corporation’s stock, or the individual partners 10% or greater interest in that partnership, as the case may be, shall also be listed. The disclosure shall be continued until names and addresses of every non-corporate stockholder, and individual partner, exceeding the 10% ownership criteria established in this act, has been listed.

12.  The bidder shall conform with Affirmative Action regulations set forth in N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq. MANDATORY AFFIRMITIVE ACTION LANGUAGE, if awarded a contract, bidder shall be required to comply with the above requirements.

13.  The Non-Collusion Affidavit, Statement of Ownership, Affirmative Action forms, etc., must be signed, completed and notarized and submitted with your bid proposal.

14.  In accordance with N.J.S.A. 40A:11-18, only manufactured products of the United Stated, wherever available, and where possible be used with this project.

15.  The contractor/vendor must comply with all provisions of the Americans with Disabilities Act (ADA), P.L. 101-336, in accordance with 42 U.S.C. S121 01 et seq.

16.  All Contractors must adhere to the provisions of the Public Works Contractor Registration Act – N.J.S.A. 34:11-56.48 et seq., as so amended by P.L.2003,c.91. The PWCRA requires that “No Contractor shall bid on any contract for public work… unless the contractor is registered pursuant to this act.” The law requires that all contractors and sub-contractors named in the proposal possesses a valid certificate at the time the proposal is received by the contracting unit, in this case the Township of Aberdeen.

The vendor, who most likely is to receive the contract award, must submit to the Township of Aberdeen, a copy of the vendor’s certification, and if applicable, copies of certification of all listed contractors. If the vendor fails to provide copies of certificates that were issued prior to receipt of proposal, the proposal will be rejected as non-responsive and offered to the next eligible vendor.

17.  As a New Jersey governmental entity, the Township of Aberdeen is exempt from the requirements under New Jersey State Sales and Use Tax (N.J.S.A. 54:32B-1 et Seq.), and does not pay any sales or use taxes. Bidders should note that they are expected to comply with the provisions of said statute and the rules and regulations promulgated thereto to qualify them for examinations and reference to any and all labor, services, materials, and supplies furnished to the Township of Aberdeen. Contractors may not use the Township’s tax exempt status to purchase supplies, materials, service or equipment.

18.  The vendor shall demonstrate business in the proper usage/cleanliness for the satisfactory performance of services described in the specifications.

19.  The quantity required herein is as set forth in detail in the form of the proposal attached hereto and made a part herein giving the description of material or services to be furnished. In the event the quantity of material herein specified has not been used by the termination date of this contract, the Township of Aberdeen has the right to cancel the balance outstanding. It is further understood that the Township of Aberdeen reserves the right to reduce or increase quantities or items listed in the bid proposal.

20.  The successful bidder shall guarantee that all goods and materials supplied shall be new, unused, and meet the specifications as noted in this bid. The Township of Aberdeen will not accept substituted items that deviate from the items listed on the purchase order.

21.  All potentially hazardous materials or substances must be properly labeled in full accordance with the New Jersey Right to Know Law – N.J.S.A. 34:5A-1 et seq. All contractors or vendors who need additional information about the New Jersey Right to Know Law are to contact the New Jersey Department of Health, Right to Know Program.

22.  In the event the successful bidder is unable for any reason, including temporary equipment failure, to furnish said material or services, the Township has the right to obtain the material or services elsewhere and to charge any additional cost to the bidder.

23.  The successful bidder shall comply with all provisions of the Prevailing Wage Act, Chapter 150, Laws of 1963 and revisions thereof, and shall sign and complete appropriate forms.

24.  The bidder shall assume all risk of and responsibility for, and agrees to indemnify, defend, and save harmless the Township of Aberdeen and its agents, employees and Council members from and against any and all claims, demands, suits, actions, recoveries, judgments and costs and expenses (including, but not limited to, attorneys fees) in connection therewith on account of the loss of life or property or injury or damage to any person, body or property of any person or persons whatsoever, which shall arise from or result directly or indirectly from the work and /or materials supplied under this contract. This indemnification obligation is not limited by, but is in addition to, the insurance obligations contained in this agreement.

The Contractor is to assume all liability of every sort incident to the work, including property damage caused by his or his men or by any subcontractor employed by him or any of the subcontractor’s men.

25.  The bidder to whom the contract is awarded for any service work or construction work shall secure, pay the premiums for and keep in force until the contract expires, insurance of the types and amounts listed below:

General Liability:

a.  The Contractor must present to the Township of Aberdeen an insurance certificate in the above types and amounts before any work or service begins.

b.  The contractor must include the following clause on the insurance certificate:

“The Township of Aberdeen is named as an additional insured”

Workers Compensation:

Bodily Injury by Accident $500,000 Each Accident

Bodily Injury by Disease $500,000 Policy Limit

Bodily Injury by Disease $500,000 Each Employee

Contract Liability Same as General Liability

Automobile Liability $1,000,000 Per Occurrence

Evidence of adequate Workers Compensation Insurance as required by the laws of the State of New Jersey and the United States, must be available for perusal. The minimum limits are state above unless a greater amount is required by law.

26.  Award will be made by the Township Council within sixty (60) days after receipt of bids. Award will be made to the lowest responsible bidder who meets the requirements of the detailed specification.

27.  The successful bidder shall execute a formal contract to fulfill the obligations incurred by his proposal within ten (10) days after notice of such award by the Township of Aberdeen.

28.  Neither the contract, nor any part thereof, nor any monies due the vendor shall be assigned without the written consent of the Township of Aberdeen.
