Terms and Conditions

Power Point Kennel hereafter referred to as SELLER, and __Kim Nguyen_______hereafter referred to

as BUYER enter into the following Agreement in connection with the purchase of the puppy described:

Puppy from Litter: Doc X Ella

Markings: White / Liver Patched and Ticked.

Sex: Female

1.  Compensation

All Puppies require a $250.00 non-refundable deposit to be deducted from the final purchase price.

1) Health

All puppies will be born into a healthy, warm environment. Tails will be docked and dewclaws removed within one week of birth. All puppies will be weaned and eating puppy food by seven weeks of age. A vaccination and deworming program has been developed and must be continued and documented by the buyer. Puppies will not be sold with any

health problems known by the seller. A certified veterinarian must examine puppy within 24 hours of pick up or delivery, for guarantees to apply. Any problems must be reported to the seller immediately.

2) Representations of Buyer

BUYER represents that it has had full opportunity to review, and has carefully examined, the contract in total.

3) Conflicts and Omissions

If BUYER believes that there is or may be any conflict between, or omission from, this Agreement, or if BUYER has any doubt as to the meaning of any item, BUYER shall immediately submit the matter to Power Point Kennels for written clarification.

4) Changes

Any changes must be submitted in writing , and agreed upon by both parties signature

5) Warranty

Seller warrants puppy described in this agreement to be healthy at the time of sale and free of genetic defects, for a period three years of age. If the puppy described is found to have health or genetic defects, buyer agrees to promptly return, the said puppy at the buyer’s expense to Power Point Kennel. Registration papers must be promptly mailed back to the seller. There are no other warranties or guarantees of any type included in this agreement.

Seller reserves the right in fulfilling the warranty to replace puppy described in this agreement with a puppy of like genetics or refund the buyers original purchase price from this agreement. Any shipping will be at the expense of the buyer. This warranty is not transferable and only applies to the original buyer.

This puppy is being sold as a non breeding dog due to an overbite. This condition will not be covered in the warranty under geneic defects. This condition has been fully disclosed prior to the sale.

6) Warranty Return Policy

In the event of a warranty return the puppy must have a current health certificate, and a up to date vaccination record singed by a certified veterinarian. Upon return the puppy must display adequate body condition, and will be evaluated by the seller with in 15 days as not gun shy, bird shy, or timid. All registration papers must be current and signed when returned. Spayed or neutered animals will not receive full refunds unless prior arrangements are agreed upon in writing between the seller and the buyer prior to the animals return.

7) Registration

All puppies will be AKC Limited Registered by the seller. All puppies will be eligible to be registered thru NAVHDA.

Pups must be registered by the new owner with Power Point as the prefix on AKC and NAVHDA registration papers. Examples; Power Point's Emma, Power Point's True Blue. Etc.

In order to obtain full AKC registration the dog covered in this agreement must:

·  Obtain title in a test or trial, or hunting companion and will meet German Shorthair Breed Standards

·  OFA Certified Hips with a Good or Excellent rating, and a CERF test of normal, at two plus years of age.

·  Must be free of any know genetic defects.

·  Seller will collect an additional $250.00 for males or females to be used as breeding stock.

·  This agreement does not control nor restrict breeding rights or privileges after terms of agreement have been fulfilled.

8) Entire Contract

This Agreement shall constitute the entire and only agreement between the parties relating to its subject matter, superseding any previous agreements or understandings. There are no agreements, understandings, or covenants between the parties of any kind, expressed or implied, oral or otherwise, pertaining to the Puppy Purchase that have not been set forth in this Agreement. This Agreement cannot be modified except by an instrument in writing signed by an authorized representative of each party.

I have read and understand that this agreement is to protect the Seller, the Buyer, the German Shorthair Breed,

and the Power Point Kennel name and reputation.
