The Company insures that the covenants, conditions and restrictions affecting the Title to the Land contained in [instrument] are unaccompanied by a right of reverter and have not been violated to the date hereof, except [list apparent violation].

Not withstanding said violation, the Company insures against loss occasioned by the enforcement or attempted enforcement of said covenants, conditions and restrictions by litigation which requires the removal of the whole or any portion of the improvements now on the Land and/or results in the collection of money damages in lieu thereof.

As used in this endorsement, the words "covenants, conditions and restrictions" shall not be deemed to refer to or include any terms, covenants, conditions or limitations contained in an instrument creating a lease.

As used in this endorsement, the words "covenants, conditions and restrictions" shall not be deemed to refer to or include any covenants, conditions or restrictions relating to environmental protection.

This endorsement is issued as part of the Policy. Except as it expressly states, it does not (i) modify any of the terms and provisions of the Policy, (ii) modify any prior endorsements, (iii) extend the Date of Policy, or (iv) increase the Amount of Insurance. To the extent a provision of the Policy or a previous endorsement is inconsistent with an express provision of this endorsement, this endorsement controls. Otherwise, this endorsement is subject to all of the terms and provisions of the Policy and of any prior endorsements.

IN WITNESS WHEREOF, the Company has caused this endorsement to be issued and become valid when signed by an authorized officer or licensed agent of the Company.
