OHIO HIGH SCHOOL ATHLETIC ASSOCIATION
NWDAB TOURNAMENT AGREEMENT
THIS AGREEMENT made and entered into ______(date) by and between the Northwest District Athletic Board of the Ohio High School Athletic Association (hereinafter “NWDAB/OHSAA”) and OTSEGO HS (hereinafter “OWNER”). The Owner shall recognize ______ as the Tournament Manager. (hereinafter “Manager”) WHEREAS, the NWDAB/OHSAA will be conducting its Sect or Dist Tournament in ______(sport) beginning ______(date) and ending ______(date) (hereinafter “Tournament”); and
WHEREAS, the OWNER desires to provide its facilities to the NWDAB/OHSAA to host contests as part of the aforementioned Tournament;
NOW, THEREFORE, in consideration of the mutual promises herein contained and for other valuable consideration, the parties hereto agree as follows:
1. The NWDAB/OHSAA shall pay to OWNER the sum of $_____.00 per game for the exclusive use of the OWNER’s facilities including, but not limited to, the playing court, spectator stands, locker rooms, parking and official score table. Said payment shall be made on or before 30 days following the conclusion of the event described herein. The fee for the Manager will be for duties directly related to the hosting of aforementioned tournament. Those duties include but are not limited to: organization of the tournament, securing game workers, collection and deposit of all monies, preparation and distribution of tickets, greeting officials, and visiting teams, preparation of game programs, completing all paperwork associated with tournament, as well as serving said Owner as the contact person with the NWDAB/OHSAA. There will be no fee available for an assistant manager. The “MANAGER” or “OWNER DESIGNEE” will attend the tournament managers meeting or forfeit $50.00 from the total manager’s fee.
2. OWNER shall make available to the NWDAB/OHSAA the aforementioned facilities for the following dates:
______, with make-up dates to be mutually scheduled with NWDAB/OHSAA.
The NWDAB/OHSAA, its employees, agents and/or representatives shall have the privilege of entering upon said facilities at all reasonable times prior to the contemplated use for the purpose of preparing said facilities for its intended use. However, if such entrance is during regular school hours, such NWDAB/OHSAA employees, agents and/or representatives shall first report to the building administrative office and follow proper visitor sign-in policies and procedures.
3. NWDAB/OHSAA’s use, as well as its employees, agents and/or representatives’ use, shall be in strict accordance with all applicable policies and guidelines of OWNER. Any infractions by NWDAB/OHSAA or its employees, agents, and/or representatives may be grounds for cancellation of this Agreement.
3. The NWDAB/OHSAA agrees to indemnify and save OWNER harmless against any and all claims arising from the NWDAB/OHSAA’s negligence and/or the negligence of the NWDAB/OHSAA’s employees agents, or representatives, which negligence occurs a) during the period of occupancy hereunder, and b) during the course and scope of said employee’s agent’s or representatives work for the NWDAB/OHSAA. In addition, OWNER will not be responsible for any loss or valuables or personal property of NWDAB/OHSAA, its employees, agents and/or representatives, or guests of the Tournaments.
4. The NWDAB/OHSAA shall secure a policy of liability from a reputable insurance company authorized to do business in Ohio, for personal injury and property damage claims and shall have limits of not less than $1,000,000 per occurrence and not less than $2,000,000 aggregate. Each party shall maintain a liability insurance policy naming the other party as an Additional Insured.
5. Notwithstanding the provisions of Paragraph 4 above, the parties hereto mutually waive the right to recovery against each other for any loss or damage to the extent that the payment therefore is made under fire or extended coverage insurance or similar insurance on any and all property, whether real or personal, at the aforementioned facilities.
6. In addition to the aforementioned facilities, OWNER agrees to provide the needed services, and the NWDAB/OHSAA agrees to pay in full for said needed services on or before 30 days following the conclusion of the event described herein, in accordance with the “SCHEDULE OF ADDITIONAL SERVICES,” below, as follows:
