Dear Ms. Minow:

I wondered if you might consider attending to some rather disturbing posts on your LibraryLaw.com Blog over the last day or so.

In case you don’t know who I am, it may interest you to know that I am the main plaintiff against Ilena Rosenthal in the defamation and libel case that is now before the Supreme Court of California. It stemmed from the reposting by Ilena Rosenthal of defamatory material that was originally authored by Tim Bolen. Details about this case can be found here:

On or about March 3, 2005 defamatory posts about me were placed by anonymous lurkers on your blog. Since there are no “Terms of Service” or “Acceptable Use Policies” anywhere on the Blog, I can assume that you approve of this. As a lawyer, you should have known that this type of defamation was possible. Blogs have to be secure from anonymous posters who intend to defame others.

I have been attacked mercilessly by the wackos in the alternative medicine community because of my activities on the internet. Many of them are from California, some are from Canada where I live.

There have been at least two separate attacks against me on your site:

The people who posted their defamatory comments are probably the same person. Their names are of course fictitious. I sent you e-mail earlier this morning and you have probably not had a chance to check you e-mail. Here is the e-mail.

One can only hope that CrazyTerry Polevoy's therapist, lawyers, and

social workers are explaining this to him while counselling him to keep his piehole shut. CrazyTerry seems to think that just because someone reacted to one of his many vitriolic and hateful attacks by calling CrazyTerry a hate mongering arshole, he has grounds for a libel and defamation action? What CrazyTerry doesn't realize is that evidence over a year old simply serves to defend the view that CrazyTerry is, in fact, a complete arsehole.

The divergence to CrazyTerry Polevoy seems to be everywhere on the

internet these days. IThe common theme concerning this man and this dispute, appears to be a number of reactions to his baseless and inaccurate accounts of things he doesn't like or perhaps more accurately doesn't understand. You really can't sue for that? Can you?

Anyway, I really don't understand how a loonie like CrazyTerry would:

1. Have the money to engage such an action.

2. The brains to pull out when it's obvious he doesn't stand a chance

in hell of winning.

Last week I was fighting a defamatory blog that a web site owned and operated by a lawyer from the University of Cincinnati. The Blog pages were removed and a complaint filed with the University of Cincinnati’s Faculty Senate. The response was nearly immediate, but the repercussions could potentially lead to disciplinary action against the faculty member and the school employee.

In your case, the issues are clearly this. Will you as a lawyer remove the offensive posts, and will you insure that your Blog is secure from defamation in the future?

I have a lawyer in California who is contemplating taking action against Google Groups for allowing additional defamatory groups. This is serious, and I intend to pursue legal remedies whenever feasible to stop this defamation against me.

It you would like to chat with me, I can provide you with my private number, or cell phone if necessary.

Please take firm action to shore up your Blog. I will be waiting for an answer over the weekend. If there is no answer, I will be asking your ISP to close your Blog down until the defamation stops.
