RULES AND REGULATIONS

General

The Rules and Regulations in their entirety as herein set forth or as they may hereafter be altered or amended in a regular and legal manner, shall govern the rendering of water service, and every Customer, upon the signing of an application for water service or upon the taking of water service will be bound thereby.

Rule No. 1 – Definitions (C)

1. Annual Line Extension Costs: The sum of a Company’s additional annual operating and maintenance costs, debt costs and depreciation charges associated with the construction, operation and maintenance of the line extension.

2. Annual Revenue: (For Line Extension Purposes): The Company’s expected additional annual revenue from the line extension based on the Company’s currently effective tariff rates and on the average annual usage of customers similar in nature and size to the bona fide service applicant.

3. Bona Fide Service Applicant: (For Line Extension Purposes): A person or entity applying for water service to an existing or proposed structure within the utility’s certificated service territory for which a valid occupancy or building permit has been issued if the structure is either a primary residence of the applicant or a place of business. An applicant shall not be deemed a bona fide service applicant if:

(a)  applicant is requesting water service to a building

lot, subdivision or a secondary residence;

(b)  the request for service is part of a plan for the

development of a residential dwelling or subdivision; or

(c) the applicant is requesting special utility service.

3.a. Company: Pennsview Water Company

4. Company Service Line: The water line from the distribution facilities of the Company which connects to the customer service line at the hypothetical or actual line or the actual property line, including the control valve and valve box. The control valve and valve box determine the terminal point for the Company’s responsibility for the street service connection.

5. Customer: A person or entity who is an owner or occupant and who contracts with the Company for water service.

6. Customer Service Line: The water line extending from the curb, property line or utility connection to a point of consumption.

7. Debt Costs: The Company’s additional annual cost of debt associated with financing the line extension investment based on the current debt ratio and weighted long-term debt cost rate for that utility or that of a comparable jurisdictional water utility.

8. Depreciation Charges: The utility’s additional annual depreciation charges associated with the specific line extension investment to be made based on the current depreciation accrual rates for that Company or that of a comparable jurisdictional water company.

9. Line Extension: (For Line Extension Purposes) An addition to the Company’s main line which is necessary to serve the premises of a customer.

10. Operating and Maintenance Costs: (For Line Extension Purposes) The utility’s average annual operating and maintenance costs associated with serving an additional customer, including customer accounting, billing, collections, water purchased, power purchased, chemicals, and other variable costs based on the current total Company level of such costs, as well as costs particular to the specific needs of that customer, such as line flushing.

11. Public Utility: Persons or corporation owning or operating equipment or facilities in this Commonwealth for diverting, developing, pumping, impounding, distributing or furnishing water to or for the public for compensation.

12. Short-Term Supply Shortage: An emergency which causes the total water supply of a company to be inadequate to meet maximum system demand.

13. Special Utility Service: Residential or business service which exceeds that required for ordinary residential purposes. See additional clarification in the main extension portion of this tariff.

14. Street Service Connection: Pipe with appurtenances used to conduct water from the main to the curb line of the premises.

Rule No. 2 – Applications For Water Service

(a) Application for a street service connection or application for water service through an existing street service connection shall be made in writing at the office of the Company by the owner of the premises to be supplied. The application for water service shall clearly outline the class, scope and type of use to be made of the service as well as the purpose for which it is to be used.

(b) Tenants may also make application for water service through an existing street service connection and may pay the charges for water service or any other charge that may accrue.

(c) Any change in the identity of the contracting Customer at a property, or in the service as described in an application will require a new application and the Company may, after reasonable notice, discontinue the water service until such new application has been made and accepted.

Rule No. 3 – Customer’s Liability for Charges

A customer who has made application for water service to any premises shall be held liable for all water service furnished to such premises until such time as the Customer properly notifies the Company to discontinue the service for his account.

Rule No. 4 – Street Service Connections

(a) The Company will make all connections to its mains and will specify the size, kind and quality of all materials entering into the street service connection.

(b) The corporation cock, curb cock, curb box and the street service pipe from the street main to the curb box laid at right angles to the main will be furnished and installed by and shall remain the property of the Company and under its sole control and jurisdiction.

(c) The curb box shall be set on a level with the grade of the sidewalk, inside of the curb line and the curb box shall be kept accessible at all times.

(d) The street service connection from the main to and including the curb box will be maintained by the Company at its expense.

Rule No. 5 – Customer’s Service Pipes

(a) The Company will specify the size, kind and quality of the materials which shall be laid between the curb cock and the structures on the premises to be supplied.

(b) The service pipe from the curb box to the place of consumption shall be furnished and installed by the Customer at his expense and risk.

(c) The Customer’s service pipe and all connections and fixtures attached thereto shall be subject to the inspection and approval of the Company before the water will be turned on.

(d) The service pipe shall be laid at all points at least three feet below the surface of the ground and shall be placed on firm and continuous earth so as to give unyielding and permanent support, and shall be installed in a trench at least two feet in a horizontal direction from any other trench wherein are laid gas pipe, sewer pipe, or other facilities, public or private, unless otherwise specifically authorized and approved by the Company.

(e) The Customer shall install a stop and waste cock of a type approved by the Company on the service pipe immediately inside the property line or the foundation wall of the building supplied, and so located as to be easily accessible to the occupants and to provide proper drainage for all of the pipes in the building and the meter if installed in the building.

(f) The Customer shall make all changes in his portion of the service pipe required on account of changes of grade, relocation of mains, or other causes.

(g) No fixture shall be attached to or any branch made in the service pipe between the meter and the street main.

(h) Any repairs or maintenance necessary on the Customer’s service pipe or on any pipe or fixture in or upon the Customer’s premises shall be performed by the Customer at his expense and risk.

(i) The Customer shall promptly notify the Company of any leak, defect, or damage affecting the service pipe between the curb box and the point where metered.

Rule No. 6 – Meters and Meter Installations

(a) The Company shall specify the kind and size of meter to be installed.

(b) Meters will be furnished, installed and removed by the Company and shall remain its property.

(c) The Customer shall provide at his expense a readily accessible and protected location for the installation of a meter at such a point as will control the entire supply to the premises, which location must be acceptable to the Company as most convenient for its service, so that the meter may be easily examined, read, or removed; and the Customer shall also provide suitable pipe connections and the necessary valves and other fittings as may be designated by the Company for the proper installation and protection of the meter.

(d) Meters will be maintained by the Company at its expense insofar as ordinary wear is concerned, but loss or damage due to hot water, freezing or other external causes shall be paid for by the Customer.

Rule No. 7 – Meter Tests and Test Fees

(a) All meters are accurately tested before installation. Meters are also periodically tested in accordance with the Public Utility Commission’s regulations. The Company may at any time remove any meter for routine tests, repairs or replacement and may, at its option and expense, test any meter when the Company has reason to believe that it is registering inaccurately.

(b) Any Customer may request the Company to make a special test of the accuracy of a meter, which test will be made in accordance with the standard regulations of the Public Utility Commission.

(c) For such special test the fee as established herein shall be paid in advance by the complainant, but should the said meter be found upon said test to be four percent or more incorrect to the prejudice of the Customer, the fee so paid shall be returned to the complainant and the meter shall forthwith be adjusted by the Company or another meter which has been properly adjusted shall be installed.

(d) For special tests of meters made upon request of the Customer, a $5.00 fee shall be paid.

(e) The test of a meter requested by a Customer should be witnessed by the Customer or his duly authorized representative.

Rule No. 8 – Discontinuance of Water Service

(a) Service rendered under any application, contract or agreement, may be discontinued by the Company after reasonable notice for any of the following reasons:

(1) For willful or indifferent waste of water due to any cause.

(2) For failure to protect from injury or damage the meter and connections, or for failure to protect and maintain the service pipe or fixtures on the property of the Customer in a condition satisfactory to the Company.

(3)  For molesting or tampering by the Customer, or others with the knowledge of the Customer, with any meter, connections, service pipe, curb cock, seal or any other appliance of the Company controlling or regulating the Customer’s water supply.
