O R D E R
The Delhi Medical Council through its Executive Committee examined a complaint of Shri Manoj Jainr/o. T-290, Gali No. 6, Gautam Puri, Delhi – 110053, forwarded by Directorate of Health Services, alleging professional misconduct on the part of doctors of Jain Charitable Hospital, in the treatment administered to complainant’s wife Smt. Nidhi Jain at Jain Charitable Hospital, Street No. 5, Raghubar Pura No. 2, Gandhi Nagar, Delhi – 110031.
The Order of the Executive Committee dated 19th February, 2014 is reproduced hereinbelow:-
“The Executive Committee of Delhi Medical Council examined a complaint of Shri Manoj Jain (referred hereinafter as the complainant) r/o. T-290, Gali No. 6, Gautam Puri, Delhi – 110053, forwarded by Directorate of Health Services, alleging professional misconduct on the part of doctors of Jain Charitable Hospital, in the treatment administered to complainant’s wife Smt. Nidhi Jain (referred hereinafter as the patient) at Jain Hospital, Street No. 5, Raghubar Pura No. 2, Gandhi Nagar, Delhi – 110031.
The Executive Committee perused the complaint, reply thereto of Dr. P.K. Bhargava, Medical Superintendent, Jain Charitable Hospital, Dr. Priyalaxmi, Gynaecologist, Jain Charitable Hospital, made to Directorate of Health Services, copy of medical records of Jain Charitable Hospital, as supplied by Directorate of Health Services.
The Executive Committee notes that in the present case since the patient Smt. Nidhi Jain had history of G6P4L2 with BOH with 36 weeks pregnancy; LSCS was indicated and the same was rightly conducted under due consent. It is, further observed that as the baby after birth started groaning; he needed NICU care for treatment.

In view of the observations made hereinabove, it is the decision of the Executive Committee that prima facie no case of professional misconduct is made out in the treatment administered to complainant’s wife or her new born baby at Jain Charitable Hospital.
Complaint stands disposed.”
