In accordance with the Bylaws: Article III Duties and Powers , para.3
“No individual Trustee, regardless of office held, committee member or chair, shall interfere with the performance of the assigned duties of the Property Manager or staff, Vendor or their designee.”
Luther Veil:
- Interferes with vendors. Received 6 incident reports, in 2008 alone, from Pro Pool for interfering with the lifeguards performing routine duties, questioning the way in which the lifeguards are trained to do their jobs, going through Pro Pool’s box of papers, and intimidating the lifeguards.
- Caused dissention among homeowners regarding the fencing on Bouquet Court by providing misinformation and promising the HOA would take care of a problem that the HOA has no authority to pursue.
- Accused an employee of DNI of possibly “rigging” the 2009 election.
- Made repeated calls to various people at DNI within 7 minutes accusing or Property Manager, Janet Lynch of no doing her job when glass bottles were discovered in the recycle bin at the pool. Pro Pool is responsible to police glass in the pool. He should have informed Janet of the problem, and let her handle it with Pro Pool, per standard procedures.
- Demanded that DNI furnish him with the Tax ID number of the association. When asked why he needed it he said "one of the homeowners wanted it". When it was pointed out that would be a violation of Bylaws and Indentures, he then stated "he needed it for the IRS and his taxes." There is no reason for any Trustee to have this information.
- Refused to attend a Special Board Meeting to discuss his false accusations and to determine what actions the Board would take in light of the accusations.
In accordance with the Indentures: Any Trustee elected under the provisions of this Article shall be an Owner in the subdivision, or an officer or agent of a corporate Owner, and if such Owner sells his or her Lot or resigns, refuses to act, becomes disabled or dies, the remaining Trustees shall appoint an Owner to act as the successor for the unexpired portion of the term of the Trustee no longer acting.
Luther Veil:
- Consistently fails to communicate with the Board through established processes, such as email. Does not communicate with the entire Board.
- He has failed to support previous Board decisions and has acted on his own to circumvent or nullify efforts by the Board to work with the City on various issues.
- Consistently acts on his own regardless of decisions of the Board as a whole.
In accordance with acceptable Trustee behavior:
Luther Veil:
- Has Accused another Board member of receiving “kickbacks” from vendors, without any supporting evidence.
- Has Accused a Board member of keeping money from processing pool passes which was unsubstantiated and proven false through an audit. Continues to bring this up at a recent Board meeting.
- Does not understand the financial statements, e.g. claimed that pool pass deposits were not on the financial statement.
- Has made accusations that Board members have received payments for services rendered, which are untrue and unsubstantiated.
- Has made accusations that the Board members are a "bunch of racist and retards". There is NO evidence of any racial issues regarding the Board.
- Ignores rules of civilized conduct for the position of Trustee at Board meetings and consistently refuses to exhibit the demeanor and/or actions required.
- Has tried to use his position to allow Residents that are in assessment arrears access to the pool.
- Has tried to use his position to intimidate other residents at the pool.
