A Regular Meeting and public hearing of the Board of Trustees of the Village of Seneca Falls, New York held on the above date beginning at 7:00 P.M.
PRESENT: Mayor Smith, Trustees Ikewood, Campese, Petroccia, and Masino; Art Seld, Village Attorney; Constance Sowards, Village Administrator; Martha Dygert, Deputy Clerk-Treasurer.
ABSENT: None.
Mayor Smith opened the meeting with the Pledge of Allegiance. / OPEN MEETING
The following communications were submitted for review/discussion:
1) Mayor Smith presented Chief Frederick Capozzi with the Chief Doyle Marquart Award – 2006 Officer of the Year. / COMMUNICATIONS

2) Village Offices will be closed from Tuesday, August 8, 2006 through Friday August 11, 2006 for file and office maintenance. / Village Office Closed
The Board was presented with minutes from the BOT Special Meetings of 5/22/06 and 7/19/06; the regular BOT meetings of 6/5/06 and 7/10/06; the Joint Town/Village Meetings of 6/20/06 and 7/5/06, and the Heritage Preservation Commission meeting of 7/25/2006. / MINUTES
On motion by Trustee Campese, seconded by Trustee Petroccia to accept the minutes as presented with an amendment to the minutes of July 10, 2006 to reflect the speaker during the Public Comment portion of the meeting to be identified as Ms. Susan Derr. / Minute Approval with Amendment

On motion by Trustee Campese, seconded by Trustee Masino to appoint Ms. Heidi Conley of 42 VanCleef Street, to the position of Zoning Officer/Code Enforcement Officer for a term to expire December 31, 2006 with an annual salary of $13,740.00 for the combined position. / APPOINTMENT

Reports were received from the Police Department, Planning Department, Street Department, Fire Department and Heritage Area.
Chief Capozzi gave an oral report to the Board based on his written report.
Christina Selvek, Heritage Area Director, gave a report on the $200K grant received for the Village through the Seneca County IDA and the $14K secured from the State for the Visitor Center.
Jeff Warrick discussed briefly the Water and Sewer Department news.
/ REPORTS
WHEREAS, the Village of Seneca Falls Board of Trustees is authorized under Village Law to audit and pay claims asserted against it; and
WHEREAS, the Board of Trustees has been presented with an abstract of unaudited vouchers #200 through #314 in the amount of $198,253.99; and,
WHEREAS, the Board of Trustees desires to audit and pay the above-referenced claims:
NOW THEREFORE, be it resolved that the Village of Seneca Falls pay the above-referenced claims against it by disbursing funds from the applicable Village accounts as follows:
General Fund: $ 84,330.06
Water Fund: $ 88,780.31
Sewer Fund: $ 22,047.42
Trust & Agency: $ 3096.42

An application was received from the St. John Bosco School for permission to host the school fundraiser “Fall Family Fun Festival” on September 22nd and 23rd with assistance from the Village as outlined on Special Event Application.

On motion by Trustee Campese, seconded by Trustee Petroccia to adopt proposed Local Law #7 of 2006 to amend the Vehicle and Traffic Code of the Village of Seneca Falls to allow a handicapped parking space on State Street, just north of Fall Street Intersection, formerly a loading zone. / ADOPT LOCAL LAW #7 of 2006

Mark Reese of 34 Maple Street addressed the Board with respect to the proposed Local Law which would allow “No Parking” signs to be placed around the median on Maple Street. Mr. Reese disagreed with this proposed law as he felt that not allowing parking in the median would cause safety concerns for the residents. He stated that his children play in the driveway at his residence and he parks in the median for this purpose. He also stated that the streets are narrow around the median and would be difficult for a car to pass through this area if cars are parked on the road. / M. Reese – 34 Maple St
Al Rescorl of 38 Maple Street was present and stated that he doesn’t understand the safety concern that was referred to by the Board, stating that there is no public safety issues with regard to parking in the median. / A. Rescorl – 38 Maple St
Diane Macaluso of 43 Maple Street was present and stated that she also disagrees with the passing of this proposed Local Law. / D. Macaluso – 43 Maple St.

WHEREAS, the east side of Swaby Street in the Village of Seneca Falls has significant drainage problems that require attention; and
WHEREAS, MRB Group has submitted a proposal to provide design plans to resolve these problems; now, therefore, be it
RESOLVED, on motion by Trustee Petroccia, seconded by Trustee Campese to approve the expenditure of $6750.00 to MRB for these plans.

A proposed Local Law was presented to the Board and public which would replace the previously adopted Local Law #9 of 1990 establishing the Urban Cultural Park Commission. The Board set the public hearing for this proposed Local Law for August 17th, 2006 at the joint Town/Village Board Meeting. / Proposed Local Law
Administrator Sowards asked the Board to consider allowing the procurement of a used lift truck which was being auctioned at the Empire Farm Days on Thursday, August 10, 2006. The Board discussed the need to discuss dollar amounts in executive session as discussion in open session might hinder the ability to bid fairly on the equipment. / NEW BUSINESS
