TERMS AND CONDITIONS FOR PURCHASE OF RICE

  1. The tenderers should furnish the proof of being manufacturer or trader of Rice.
  2. The rates quoted should be F.O.R. Nawanshahar (Punjab) exclusive of all taxes.
  3. The tenderers will have to deposit Rs. 25,000/- (Rs. Twenty five thousand only) as earnest money. Tender without earnest money will not be accepted. The earnest money of successful tenderers will be adjusted towards security.
  4. In case of party failing to supply the material as per schedule or as per specifications, earnest money/security will be forfeited and Markfed shall be at liberty to purchase remaining rice at risk & cost of the party.
  5. The quantity of rice may vary upto ± 5 % of the purchase order.
  6. Offers can be made only for a minimum lot size of 15 MT. Offers for less than 15MT shall not be considered unless the remaining quantity is less than 10 MT.
  7. The party has to supply the stocks within 10 days positively from the date of supply order issued otherwise Rs. 10/- per Qtl. cut per day will be imposed as penalty for 15 days. After that the tender shall be rejected, security forfeited and material shall be purchased at the risk and cost of the supplier.
  8. The party shall be allowed to offer one lot, one sample for each variety only.
  9. The stocks shall be Sortex and cleaned.
  10. The decision of the committee will be informed to the successful bidder only and no intimation will be sent to the unsuccessful parties.
  11. On receipt of stocks, representative samples shall be drawn from the consignment which will be got tested from a reputed laboratory. Results of the Lab shall be binding upon both the parties. Samples with supplier and Markfed can be retained as reference samples in case of dispute.
  12. In case stocks are rejected, the same shall be taken back by the supplier at his own cost, failing which Markfed shall be at liberty to dispatch the same by trucks to the suppliers premises at suppliers cost.
  13. If it is observed that poor quality of stocks are supplied by the party, Markfed has the right to cancel the contract and in such circumstances, no claim will be entertained whatsoever and the loss on this account will be sole responsibility of the supplier.
  14. The conditional tenders will not be accepted.
  15. Stocks should be in 50 kg net weight packing and the rates quoted shall be inclusive of bardana. Rice can be packed in once used serviceable bags.
  16. In case of non furnishing of all or any of the document as asked in technical bid (Annexure-I), the tender shall be rejected outrightly and the fiancial bid (Annexure-II) of successful parties shall be opened only..
  17. In case of minor variations in the specifications/quality of rice, the stocks may be accepted by Markfed by imposing quality cuts as deemed fit at the sole discretion of Markfed.
  18. For the purpose of payment the quantity of naked grain shall be taken i.e. excluding bardana weight.
  19. 90% of the payment shall be released on receipt of stocks at destination and 10% balance payment shall be released on the receipt of analysis report confirming that stocks are as per specifications ( Annexure-II).
  20. The seller shall not sublet, transfer or assign contract or any part thereof without the prior written approval of Markfed.
  21. Any change in the constitution of the firm shall not absolve any partner of the firm from its liability unless it is agreed to by the Markfed in writing.
  22. Quantities can be increased or decreased at the sole discretion of Markfed.
  23. The security deposit shall be refunded to the party after the successful completion of the contract and obtaining “No dues certificate from Manager, Rice Mill at Nawanshahar.
  24. Markfed, reserves the right to cancel any or all the tenders without assigning any reason.
  25. In case of any dispute or difference which may arise between the supplier and Markfed or their representative with regard to the consideration, interpretation and effect of the agreement or any part thereof, the matter shall be referred for arbitration to Managing Director, Markfed Chandigarh or his nominee for adjudication of the dispute under the Arbitration and conciliation Act 1996, whose decision shall be final and binding on both the parties.
  26. In case of any change in tender documents, the corrigendum/addendum will be uploaded only at and etender.punjabgovt.gov.in . All the proceedings under the agreement or otherwise shall bewithin the jurisdiction of Chandigarh Courts only.
  27. For participating in the above E-tendering process, the tenderers shall have to get themselves registered with etender.punjabgovt.gob.in and get user ID, password. Class-3 digital signature is mandatory to participate in the E-tendering process.
