  1. INSURANCE INFORMATION:

OWNER(S) agree to keep boat fully insured with complete marine insurance and releases MARINA from any and all liability from loss, injury or damages to persons or property sustained while in or on MARINA facilities or premises. MARINA does not carry insurance covering the property of the OWNER(S). As OWNER(S) we certify that the above described boat is insured with:

  1. OWNER(S) shall furnish MARINA with a full set of keys or combinations to the boat. The boat will only be entered by MARINA for periodic inspections or emergency.
  2. MARINA reserves the right to assign all slip space.
  3. MARINA reserves the right to lease or refuse to lease to any person for any good and pertinent reason.
  4. OWNER(S) shall notify the MARINA of all float plans that will be in excess of 24 hours. MARINA will attempt, but cannot guarantee, to keep slip space available for OWNER(S) return Failure to notify could result in inconvenience.
  5. MARINA cannot and does not guarantee the continuity of electrical power where provided.
  6. The use of MARINA’S electrical service for the operation of heaters or air conditioning units is prohibited except by special permission and the payment of established fees.
  7. OWNER(S) may not sublet assigned slip space and shall not slip a boat other than the one described in item (2) without written consent of MARINA. Boats slipped without authorization will be lifted and placed in storage at owner’s expense and a lien placed against the boat.
  8. OWNER(S) agrees to abide by the terms and conditions set forth in this agreement, all rules and regulations set forth by MARINA, and all applicable federal, state, local laws or ordinance.
  9. OWNER(S) agrees that this is an agreement for rental and facilities, together with the use of drives and parking areas and is not a bailment agreement.
  10. Dock or dunage boxes must be approved by MARINA.
  11. No fueling of boats at docks from any container or by any outside supplier. Boats can be fueled at fuel dock only. (MI Law)
  12. Should any dispute arise between MARINA and OWNER(S) agrees to submit and be bound by binding arbitration as developed by Michigan Boating Industries Association of Livonia, Michigan.
  13. MARINA has all the appropriate liens, state or federal, on the OWNER’S boat, motor and all accessories to secure any and all fees, repairs, fuel, oil, hardware or other accessories or any other services or materials rendered to or supplied to OWNER. In the event OWNER becomes delinquent in payment for fees or other charges as described in this item MARINA shall have the right to the space which could result in inconvenience. Take over the property of the OWNER(S) and secure the property to the space or store it in any location. Space made available by removal of OWNER(S) property may be made available to another OWNER at the discretion of the MARINA. MARINA shall be entitled to a possessory lien on said boat and\or equipment for any and all monies owed by the OWNER to MARINA for said charges, work performed, services rendered and materials furnished to the OWNER, his boat or the boats equipment. MARINA may refuse to permit any stored items to be removed from MARINA premises until all of the terms and conditions of this agreement have met. Such possessory lien may be enforced in accordance with PUBLIC Act No. 362 of 1998. MARINA shall also have a maritime lien upon the boat, engines, gear, equipment and appurtenances to secure payment for any and all services and materials supplied to OWNER by MARINA.
  14. In the event suit is brought in behalf of MARINA against OWNER(S) to collect amounts due or to become due hereunder or to enforce an appropriate maritime lien, OWNER(S) shall pay the MARINA’S reasonable attorneys fees for such suit or collection plus cost as provided by law.
  15. In case of emergency, as determined by MARINA, MARINA shall have the right to move the subject boat, if possible and practical, to a safer area to protect the boat, property or general welfare if boat is unattended and OWNER(S) cannot be reached. However under no circumstances is MARINA under any obligation to provide this service. Costs incurred by MARINA shall be billed at the yard rate. OWNER(S) agrees to indemnify MARINA and hold harmless from any and all liability, loss or damage caused by or to the subject boat which may arise out of failure of the OWNER(S) to move the boat, the inability of MARINA to reach OWNER(S) or by the movement of the boat by MARINA. In general, OWNER(S) shall be solely responsible for any emergency.
  16. OWNER(S) agrees that only reasonable and customary use will be made of docks and facilities covered hereby; that no unnecessary wear and tear, disturbance, nuisance, rubbish or garbage will be permitted on the dock or premises and that OWNER(S) will keep dock and premises covered hereby free and clear of gear, tackle and other obstructions.
  17. No boat is to be removed from its space unless all charges for space rental, service and\or materials have been paid in full.
  18. OWNER(S) are responsible for having their boats properly moored at the slip or properly prepared with antennas down, trim tabs up and gear stowed for lifting for rack.
  19. OWNER(S) may work on his/her boat if such work does not interfere with the rights and privileges of other OWNERS. OWNERS desiring to use an outside or independent contractor must first notify MARINA of the contractor to be employed and inform the contractor of the following requirements:

(A)An outside contractor must register at MARINA office. And pay $100\day that work is preformed on premises.

(B) Provide MARINA with a written certificate of insurance in amount equal to or exceeding the amounts carried by MARINA.

(C)MARINA must be shown as named insured and also as an additional loss payee.

(D)Contractor must also sign an indemnity waiver.

(E)Contractor is only allowed to work during normal business hours.

(F)OWNER(S) or outside contractor is not permitted to work inside any building.

(G)OWNER(S) are responsible for all clean up.

(H)Toxic waste is to be in proper containers for disposal by MARINA. A fee will be charged.

  1. Campers not permitted overnight, city ordinance.
  2. Trailers, cradles left on MARINA’S premises are left at OWNER(S) risk. MARINA is not responsible for any loss or damage to cradles trailers or frames. A storage fee of $150.00 will be charged for trailers left on MARINA’S premises per season.
  3. No outside brokerage services allowed on All Seasons Marine property or docks.
  4. Any infraction of the rules and regulations contained herein or as posted in the MARINA office shall, at the option of the MARINA, cancel this agreement upon 10 days notice, and OWNER(S) shall remove his/her boat from premises.
  5. All waste material must be properly bagged and placed in dumpsters.
  6. SEVERABILITY: Should any of the rules contained herein or any of the posted rules and regulations be found to be unenforceable all remaining parts of this agreement or posted regulations remain in effect.

All Seasons Marine Inc’s. Best Management Practices include:

  • No fueling at slip, only allowed at gas dock by trained personal.
  • Fish cleaning allowed at fish cleaning station only. All fish waste must be disposed of in dumpster.
  • All pets must use designated pet walk areas. Pet mitts supplied.
  • All waste oil and filters must be disposed of with All Seasons Marine Inc. to be recycled.
  • All sanding and painting must be done in designated areas. Use of vacuum sanders required. No spray painting allowed.
  • Use of propylene glycol antifreeze required for winterizing. Any use of ethylene antifreeze must be recycled with All Seasons Marine Inc...
  • Use of environmentally friendly boat cleaning detergents required.
  • Power washing allowed only in designated area by All Seasons Marine Inc. personal.
  • Battery disposal must be given to All Seasons Marine Inc. to recycle.
  • All Shrink wrap must be given to All Seasons Marine Inc. for recycling.
  • To control the spread of aquatic invasive species. All live wells and lake water must be cleaned before boat is transported out of area.
  • Michigan is a no discharge state.
