This is the last Will and Testament of me Henry Cross late of Lidstone but now of Chipping Norton ... yeoman ...

  • All my debts, and particularly reasonable allowances are to be made to my son Augustine Cross for services rendered by him and his wife in the transaction of my business during my illness and their personal attentions for my comfort, and funeral and testamentary expenses are to be paid.
  • I give all sums of money about my person or due to me, also my three freehold Messuages Cottages or Tenements, gardens etc at Lidstone now in the occupations of William Thomas, John Pinfold and Edward Profis, and all my other estate and effects both real and personal, to Edward Sumner Dodd of Chipping Norton, baker, and his heirs etc Upon Trust to collect such parts as are money or securities, and to sell all other parts of my estate; and then Upon Trust to pay out:
  • One ninth to my son Cornelius Cross for his own use and benefit.
  • One ninth to my son Deodatus Cross for his own use and benefit.
  • One ninth to my son Augustine Cross for his own use and benefit.
  • One ninth to my son Barnet Cross for his own use and benefit
  • One ninth to my son Elijah Cross for his own use and benefit.
  • One ninth to my son Zachariah Cross for his own use and benefit.
  • Two ninths to my son Noah Cross for his own use and benefit.
  • The remaining ninth to the two children of my late son Aden Cross deceased when they reach 21 in equal shares, and in the meantime during their minority to invest their shares in the Banbury Savings Bank at compound interest.

This is the last Will andTestament of me
Henry Cross late of Lidstone but now of Chipping Norton in the
County of Oxford, Yeoman. I direct all my just debts and
particularly the reasonable allowances to be made by my Son Augustine
Cross for services rendered by him and his wife in and about the
transaction of my business during my illness and their _____
of their personal attentions for my comfort therein and funeral and
testamentary expences be duly and fully paid and satisfied by my
Executor hereinafter named as soon as conveniently may be
after my decease. I give devise and bequeath all sums of money
in and about my person or due to me at the time of my decease
And also those my three freehold Messuages Cottages or
Tenements Gardens hereditaments and premises situate at Lidstone
aforesaid now or late in the respective occupations of William
Thomas,John Pinfold and Edward Profis and all and every
other my Estate and Effects whatsoever and wheresoever both real
and personal whether in prossession or reversion remainder or expectant
unto Edward Sumner Dodd of Chipping Norton aforesaid Baker, his
heirs executors administrators and assigns Upon Trust as soon as
conveniently may be after my decease to collect get in and receive
such parts thereof as shall consist of money or securities for money
and to sell dispose of and convert into money all other parts of my
real and personal Estate either by public Auction or private contract
as to my said Executor shall seem meet And upon further trust
when and so soon as the whole of my real and personal Estate
shall have been converted into money and received Upon trust
to pay one ninth part or share thereof unto my Son Cornelius
Cross for his own use and benefit And to pay one other equal
ninth part or share thereof unto my Son Deodatus Cross for his
own use and benefit And to pay one other equal ninth part or
share thereof unto my Son Augustine Cross for his own use
and benefit And to pay one other equal ninth part or share thereof
unto my Son Barnet Cross for his own use and benefit And to pay
one other equal ninth part or share thereof unto my Son Elijah
Cross for his own use and benefit And to pay one other equal ninth
part or share thereof unto my Son Zachariah Cross for his own use and

benefit And to pay two equal ninth parts or shares thereof unto
my Son Noah Cross for his own use and benefit And to pay over
the remaining ninth part or share thereof unto the two children
of my late Son Aden Cross deceased when and as they shall
severally and respectively attain the age of twentyone years in
equal shares and in the meantime and during the minority of such
my Grandchildren to invest the said shares in their respective names
in the Banbury Savings Bank so that their respective shares may
accumulate in the nature of compound interest And I direct that the
receipts of my said Executor for the purchase money of my real and
personal Estate or to any person or persons who shall have any of
the trust moneis in their his or her hands and shall pay the same
to the said Executor shall be good and sufficient discharges to such
purchaser or purchasers or other person or persons as aforesaid and that
such purchaser or purchasers or other person or persons shall not be
obliged to see to the application thereof And I do hereby nominate constitute
and appoint the said Edward Sumner Dodd Executor of this my Will and
hereby revoking and making void all former or other Wills by me at any
time heretofore made I do declare this to be my last Will and Testament
In witness whereof I the said Henry Cross have to this my last Will and
Testament set my hand the First day of March in the year of our Lord
one thousand eight hundred and fifty nine. Henry Cross
Signed by the said Testator Henry Cross and acknowledged by him to
be his last Will and Testament the words "shall be good and
sufficient discharges to the purchaser or purchasers thereof and
"that such purchaser or purchasers" and again the word "other"
obliterated in the twentysixth, twentyseventh and twentyeighth
lines on the second page of this sheet of this paper having been
previously obliterated, in the presence of us present at the same time
and subscribed by us in the presence of the said Testator and of
