MINUTES OF A MEETING OF THE PLANNING ENVIRONMENTAL AND GENERAL

PURPOSES COMMITTEE HELD ON MONDAY 25SEPTEMBER 2017

Present:Councillor Noon (Chair), Councillor Bampton, Councillor Butterfield, Councillor Maxfield and Councilor White.

Public Session – There was one member of the public in attendance who wanted to raise some issues about Application number 2017/62/93015/W - Erection of 19 dwellings (C3) with associated parking with vehicular access at Rough Nook Farm, 112, Mill Moor Road, Meltham, Holmfirth, HD9 5LWfor Pennine Developments Ltd. The resident also had general concerns about the current building works on Mill Moor Road. The resident explained she had come along to express her objection to the application to build more houses on Mill Moor Road. She expressed the view that the whole area was a building site and that it was noisy, dirty and disruptive the residents that lived there. She suggested that the building works had resulted in the absence of bats in the areaand that getting out of the junction at the bottom of the road was very difficult. The resident asked what could be done to stop the development and improve the situation for residents.

Councillor White suggested that if the builders were creating a nuisance then Kirklees Council may be able to take action. Councillor Maxfield also suggested that speaking to the site manager may also result in improvements. It was suggested that if there were particular issues the Town Council could send correspondence to the enforcement section at Kirklees Council.

17/174PLANNING APPLICATIONS.

The Committee considered the following planning applications:

RESOLVED:That the agenda be taken out of order at this point and that Application number 2017/62/93015/W be considered first.

Application number 2017/62/93015/W - Erection of 19 dwellings (C3) with associated parking with vehicular access at Rough Nook Farm, 112, Mill Moor Road, Meltham, Holmfirth, HD9 5LWfor Pennine Developments Ltd.

Councillor White explained that the sites at Mill Moor Road had been allocated for housing in the UDP in the 1990s and this was re-confirmed in the emerging Local Plan. It was noted therefore that objecting to applications on the basis that they were housing development would be meaningless but this was often not well received by residents. However, Councillor White confirmed that in both the UDP and the emerging Local Plan there were no sites further up Mill Moor Road and the Local Plan will be in place until 2028. It was noted that what happened in the 1990s is unknown but residents may find in reassuring that the position is now fixed until 2028 and that there are no further sites identified. Councillors acknowledged the concerns residents have about highway capacity but noted that when this has been raised in the context of previous applications the planning authority have replied that there are other routes available to road users. Councillors noted that the development will lead to an increase in cars on Mill Moor Road and exacerbate the existing traffic problems. It was noted that a traffic survey had been completed in relation to an earlier application on Mill Moor Road but Councillors felt that a traffic assessment should be done on the whole of the Mill Road sites that are allocated for housing. Councillor White suggested that in relation to this site there are legitimate concerns over the drainage and further information about this is needed. At present the proposal is for drainage into the dyke but Councillors felt that additional controls maybe needed as had happened in relation to other applications in the vicinity. Councillors noted that there was no information about affordable housing in the application and that all the schools in Meltham are oversubscribedthis year and that the school place capacity did not exist to accommodate further development. Lastly Councillors requested information about any Section 106 agreement which would be entered in relation to this site.

RESOLVED: That the Council object to the application for the following reasons:

  • The capacity of the physical infrastructure in relation to the public drainage and water systems is inadequate and the current drainage proposals for the site are inappropriate.
  • There is no information about the provision of affordable housing.
  • The proposed development gives rise to a number of highway issues particularly traffic generation and vehicular access issues. The development will give rise to an increase in the number of cars on Mill Moor Road which is already exceptionally busy and create further problems regarding vehicular access to Station Street. A traffic assessment should be completed on the totality of the Mill Moor Sites allocated for housing in the UDP/ local plan.
  • Deficiencies in social facilities, in that this year all the schools in Meltham are over fulland that the school place capacity does not exist to accommodate further development..

Application number 2017/44/92852/W - Discharge conditions 3 (materials) and 5 (windows/doors) on previous permission 2017/91726 for Listed Building Consent for installation of additional windows and material change to roof at Heady Fields Barn, Wilshaw Road, Meltham, Holmfirth, HD9 4DZfor Anthony Dearnley Homes Ltd.

It was noted that a decision had been made in respect of this application and therefore there was no need for further consideration.

Application number 2017/62/92789/W - Erection of front porch at 135, Helme Lane, Meltham, Holmfirth, HD9 5RLfor C Mason.

RESOLVED: That the Council supports the application.

Application number 2017/62/93036/W - Erection of single storey rear extension at 3, Grasmere Road, Meltham, Holmfirth, HD9 4HFfor A Prady.

RESOLVED: That the Council supports the application.

Application number 2017/CLASS Q/93073/W - Prior approval for proposed change of use of agricultural building to one dwelling and associated operational development at buildings adj, Rough Nook Farm, 112, Mill Moor Road, Meltham, Holmfirth, HD9 5LWfor Mr & Mrs Wood.

RESOLVED:That the Council objects to the development for the reasons of overdevelopment in the context of the planning consents already granted for housing on Mill Moor Road and Application number 2017/62/93015/W. In isolation, the Council would have supported the application but believes that the density of housing on Mill Moor is not supported by the infrastructure. In particular the development of the Mill Moor Road sites as a whole gives rise to a number of highway issues particularly traffic generation and vehicular access issues. As a whole thedevelopments will give rise to an increase in the number of cars on Mill Moor Road which is already exceptionally busy and create further problems regarding vehicular access to Station Street. A traffic assessment should be completed on the totality of the Mill Moor Sites allocated for housing in the UDP/ local plan. The Council also suggests that there are deficiencies in social facilities, in that this year all the schools in Meltham are over full. The Council suggests that there is a need for the applications for residential development in this area to be reviewed as a whole.

Application number 2017/62/93081/W - Erection of agricultural building at High Brow Farm, Crosland Edge, Meltham, Holmfirth, HD9 5RSfor Heath Jackson.

RESOLVED:That the Council objects to the application on the grounds that this is greenbelt land and the application does not demonstrate clear evidence of agricultural use for the building. The Council requests that there is an agricultural use assessment undertaken before consent is granted for this application.

Application number 2017/70/93105/W - Variation of condition 2 (Plans) on previous application 2015/90732 for erection of first floor extension to form two storey dwelling at 112A, Mill Moor Road, Meltham, Holmfirth, HD9 5LWfor Pennine Developments (UK) Ltd.

RESOLVED: That the Council notes the application.

RESOLVED:That the Council notes the application and would comment that the existing proposals to install PVC black guttering are not sufficient to meet the conditions for approval and would suggest that the guttering works should be completed in cast iron effect guttering.

17/177CO-ORDINATION OF VILLAGE CLEAN UP

The Clerk asked about the priorities for the caretaker in the next period and it was agreed that the caretaker should be instructed to undertake some additional works within Robert Ashton Memorial Park in particular some general tidying of woodchips that have fallen onto the paths and leaf clearance from the paths. It was also requested that the replacement of the locking stump at the park approved at Properties Administration and Finance on the 18 September be prioritised due to concerns about the security of the park. The rubbish left on the football pitches following matches was also raised and Councillor White agreed to speak to the football club about this issue. A discussion took place about whether the Council could clean up the fences around Morrisons which are covered with old posters and the litter trapped in the cliff face. However, it was noted that this is the responsibility of Morrisons and it was agreed that the Clerk write to the Morrisons Store Manager to request a meeting between the manager and representatives of the Council’s Planning Committee to discuss these issues.
