AFTON TOWN COUNCIL MEETING

NOVEMBER 14, 2017

5:00 P.M.

Mayor Joel Neuenschwander called the regular meeting of the Afton Town Council to order at 5:00 p.m. and welcomed those in attendance.

Those present included Mayor Joel Neuenschwander, Council Member Tom Davis, Council Member Rick Merritt, Council Member Barbara Sessions with Council Member Jason C. Inskeep being excused from the meeting. Others present included Town Attorney Dale Cottam, Town Administrator Jonathan Teichert, Town Clerk Lisa Hokanson, Afton Municipal Court Judge Rod Jensen, Afton Police Chief Jason Romberg, Jeanne Finch, Jason Sleight, Sandie Jensen, Dave Major, Casey Morley, John Price, Mallory Winters, Bill Spaulding, Sarah Hale, Kate Johnson, Lynette Johnson, and Lyniece McKim.

Mayor Neuenschwander led those present in the Pledge of Allegiance.

Mr. Jason Romberg, Afton Police Chief, advised that the grant application pertaining to the highway safety grant has been completed and submitted.

Chief Romberg discussed the municipal ordinances pertaining to sentencing and probation. Mr. Rod Jensen, Afton Municipal Court Judge, discussed the terms for probation and the sentencing of individuals to jail. Mr. Dale Cottam, Town Attorney, proposed different classes of misdemeanors and asked that they be put into the Town Code. The Council authorized them to begin working on this matter for the Council’s consideration.

Mayor Neuenschwander presented the Afton Municipal Court docket for October, 2017.

Mr. Jason Sleight, representing Jones Simkins, presented the 2016/17 fiscal year audit report for the Town. He presented graphs for each enterprise fund for the previous three years pertaining to the revenues and expenditures for each fund. Mr. Sleight thanked the Town and staff for their help with the audit.

Mayor Neuenschwander presented a proclamation pertaining to Afton Apprenticeship Week which honors and encourages industries who utilize or benefit from the apprenticeship model to train Afton workers and to recognize the role the apprenticeship system has played in preparing Afton apprentices for sustainable careers. At the call of the Mayor, Council Member Davis made a motion to pass the proclamation as presented, seconded by Council Member Merritt. Motion carried.

Mrs. Lyniece McKim presented a request to hook onto the Town’s water line on behalf of a family member. The proposed hook up request is not located within the Town limits. However, the water line does go in front of the property that she is requesting a water hook up. Mr. Cottam stated that the current Town Code states that water that is sold out of Town must be reviewed on a case-by-case basis. After some discussion, Council Member Merritt made a motion to deny the request at this time due to the fact that the Council is currently considering that future out of town water purchases be contingent upon annexation and the permit application be in the property owner’s name. Council Member Sessions seconded the motion. Motion carried.

Mayor Neuenschwander advised that the Afton Tourism Board recently received a funding request from the Star Valley Shoot Out in the amount of $15,000. The event is scheduled to be held December 14 -16, 2017. He advised that the Board recommended approval of the request. At the call of the Mayor, Council Member Davis made a motion to authorize the expenditure of funds from the Afton Tourism Board in the amount of $15,000 to be used for the upcoming Star Valley Shoot Out event. Council Member Sessions seconded the motion. Motion carried.

Town Attorney Cottam presented Ordinance 644 for first reading, an ordinance amending Town Code provision §8-3-01, which limits water service to properties within the Town municipal limits and repeal Town Code provisions §8-3-02 through §8-3-04. The ordinance states that the property to receive water service must first be annexed into the Town. When annexation is not possible or practical, and if there is surplus water not required by residences within the corporate limits of the Town, the Council may in its discretion determine to sell water to users outside the corporate limits of the Town. No sale of water may be approved by the Council unless the owners of the property to receive the water service agree to be annexed if and when requested by the Town. At the call of the Mayor, Council Member Davis made a motion to pass Ordinance 644 on first reading, seconded by Council Member Sessions. Council Member Merritt voted nay. Mayor Neuenschwander voted in favor of the motion. Motion carried.

After some discussion, Council Member Merritt made a motion to place a moratorium on the selling of water outside of the Town limits, seconded by Council Member Sessions. After further discussion, Council Member Davis, Council Member Sessions, and Mayor Neuenschwander voted nay to place a moratorium on the selling of water outside of the Town limits. Council Member Merritt voted in favor of the motion. Motion failed.

Mayor Neuenschwander presented the consent agenda, which included:

1.Approval of the minutes from the regular Afton Town Council meeting held October 10, 2017.

2.Approval of the business licenses and building permits issued for October, 2017.

3.Approval of the bills against the Town of Afton for the period ending October 31, 2017.

At the call of the Mayor, Council Member Merritt made a motion to approve the consent agenda as presented, seconded by Council Member Davis. Motion carried.

Council Member Sessions was excused from the meeting at this time due to other commitments.

Town Attorney Cottam discussed the current Town Code book and suggested that the Council consider reviewing it and updating the items needed. He asked that a committee be appointed to propose updates and revisions to the code. This matter will continue to be discussed and possibly a committee formed to help with this item.

Mr. Jonathan Teichert, Town Administrator, presented the Afton financial statements for the period ending October 31, 2017.

Mr. Teichert advised that a resident has expressed concerns pertaining to the location of the school crossing zone signs. Mr. Teichert stated that he would research the costs pertaining to flashing signs in order for them to be more visible.

Mr. Teichert presented a proposal he recently received pertaining to a sign to be located at the golf course. He stated that the Town has been asked to help with the costs of the sign, which would be used to advertise the golf course. The Council took no action at this time pertaining to this matter.

Mr. Teichert presented the revenues and expenditures pertaining to the recent purchase of the Forest Service building.

Mayor Neuenschwander presented the minutes from the Afton- Lincoln County Airport Board meeting held October 25, 2017.

Mayor Neuenschwander presented a notice from the Local Government Liability Pool pertaining to claims that have been filed.

At the call of the Mayor, Council Member Merritt made a motion to adjourn the regular meeting of the Afton Town Council, seconded by Council Member Davis. Mayor Neuenschwander voted in favor of the motion. Motion carried. The regular meeting adjourned at 7:25 p.m.

The next regular meeting of the Afton Town Council will be held on Tuesday, December 12, 2017, at 5:00 p.m. at the Afton Town Hall.
