ItisthepolicyofKansas WorkforceONE (WF1)thatallworkforceprogramsoperatedbyorunderthe

WF1shall beoperatedinconformancewithallapplicablelawsandregulations.ItisalsothepolicyoftheWF1thatnoprogramorprovisionofservicesunderthoseprograms shallal1owdiscriminationonthebasisofrace,color, national origin,age,gender, political affiliation, belief, citizenshipordisability.

Who May File-Anyapplicant,participant,service provider, operator,partnerorother interested partymayfileacomplaint allegingaviolation oflocalprograms,agreementsorWF1policies andactivities.

Complainantswith Disabilities-Complainantswithdisabilitieswillbeaccommodatedincommunicationand location. Alternateformatswillbeusedonrequest tonotifythecomplainantofhearings, resultsandanyotherwritten communication. Auxiliaryaidesandservices,suchasdeafinterpretersorassistive listeningdevices, willbeprovided onrequest for negotiations,hearingsandanyother meetings whereauralcommunicationoccurs. Anaccessiblelocation willbeusedfor hearingsandother meetingsonrequest.

Time and Placefor Filing-ComplaintsmaybefiledwiththeWF1ortheservice provider withinoneyearfrom thedateofthe event orconditionalleged tobeaviolation. ResolutionProcess-Service providersandemployersofparticipantsmusthaveproceduresinplacetoprocess complaintsrelated totheterms andconditionsoftheparticipant'straining oremployment. Employersandservice providersmayelectto utilizethesystem establishedbytheWF1oroperate theirowncomplaintprocedures.Iftheemployerisrequired tousethe complaintprocessingproceduresunderacovered collectivebargainingagreement,thenthoseproceduresmaybeusedtohandle general complaints.

Anyhearingsconductedbyanemployermustcomplywithallprovisionsforhearings described inthispolicy.

Step1Initial Review-Ifthecomplaintallegesaviolation ofanystatute, regulation,policy,orprogram thatisnotgovernedbyWIOA,thecomplaintwillbereferred totheappropriateorganizationforresolution. Noticeofthereferral willbesenttothe complainant.

TheWF1ortheserviceprovider willreceivethecomplaintfromthecomplainantorthecomplainant'sdesignatedrepresentative. Allcomplaintswillbelogged. Acomplaint fileshould beestablishedthatcontainsthefollowing:

I.Applicationandenrollmentforms;

2.CompletedGeneral WlAComplaint Form(orcomplainant'swritten statement);

3.Chronologicallogofeventsorconditionsalleged tobeaviolation;

4.Any relevant correspondence;and

5. Record oftheattemptedinformal resolution.

Step2-Informal Resolution-Anattempt shouldbemadebytheWF1ortheserviceprovidertoinformallyresolve thecomplaint tothesatisfactionofallparties. The informalresolutionprocess mustbecompletedwithintenbusiness days fromthedatethe complaintisfiled.Ifallpartiesaresatisfied, thecomplaintisconsideredresolved andthetermsandconditionsoftheresolution must bedocumentedinthecomplaintfile. Whenaservice providerattempts theinformal resolution,theserviceprovider willforward thecomplaintfiletotheWF1. TheWF1willreview thecomplaintfileand investigateitfurther ifnecessary.

Step 3-FormalResolution-Whenaninformal resolutionisnotpossible, theWF1willissue•determinationwithin 20calendar daysfrom thedatethecomplaintwasfiled.Ifanappeal ofthedeterminationisnotrequested, thecomplaintisconsidered resolvedandthecomplaintfileshould bedocumentedaccordingly. Anypartydissatisfiedwiththedeterminationmayrequest ahearing within 14calendardaysofthedateofthedetern1ination.

Step4-Hearing-Acomplaintmaybeamendedorwithdrawnatanytimepriortoascheduledhearing.

Ifthecomplaintisnotwithdrawn,theWF1willrequestthattheWorkforceComplianceandOversight,LegalServicesDivisionof theKansasDepartmentofCommerce,1000S.W.Jackson,Suite100,Topeka,Kansas66612designateahearingofficerto ensure thecomplaintreceivesfairandimpartialtreatment.Thehearingmustbeconducted within45calendardaysfromthedatethe complaintwasfiled. Thehearingofficerwillscheduleaformalhearingandmailawrittennoticetothecomplainant,the respondent,andany otherinterestedpartyatleastsevenbusinessdayspriortothehearing. Thenoticewillincludethedate,time andplaceofthehearing.

Partiesmaypresentwitnessesanddocumentaryevidence,andquestionotherswhopresentevidenceandwitnesses.Thecomplainant mayrequestthatrecordsanddocumentsbeproduced. Attorneysoranotherdesignatedrepresentativemayrepresent eachparty. Alltestimonywillbetakenunderoathoraffirmation.Thehearingwillbe recordedeitherinwritingorbyaudiotape. Thehearingofficer'srecommendedresolutionwillincludeasummaryoffactualevidencepresentedduringthehearingandthe conclusions uponwhichtherecommendation isbased.

Step5-FinalDecision-theWF1willreviewtherecommendationofthehearingofficerandissueafinaldecisionwithin60 calendardaysfromthedatethecomplaintwasfiled.

Step6-Appeal-AnypartydissatisfiedwiththeWF1finaldecision,oranypartywhohasnotreceivedeitherafinaldecisionor aresolutionwithin60calendardaysfromthedatethe ccomplaintwasfiled,mayrequestanappeal.Theappealmustbe received bytheKansasDepartmentofCommerce(Commerce) within90calendardaysfromthedatethecomplaintwasfiledatthe followingaddress:KansasDepartmentofCommerce,WorkforceComplianceandOversight,1000S.W.JacksonStreet,Suite
