Opening Remarks and Introductions
Welcoming remarks, attendees introduce themselves. A sign-in sheet will be circulated.

08:35 – ESAR Requirements
To follow-on discussions at the January 14, 2006 Committee meeting, the challenge of how the Customs Committee can serve to prepare NCBFAA members for the exigencies of ESAR will be taken up (see Attachment "A").

09:10 – Expansion of Nationally Permitted Customs Business
The Committee will consider the apparent drive of CBP to expand the scope of the national permit in the context of an NCAP pilot (see Attachment "B").

10:20 – Customs Business Restrictions
A recent Pipeline issued by CBP Otay Mesa as reinforced by an Administrative Message, and apparently derivative of HQ Information Letter 115858 dated February 10, 2003 (see Attachment "G") requires examination in terms of commercial realities especially in the context of border brokerage operations (see Attachment "C" and Attachment "D"), and CBP HQ Ruling 116189 dated June 9, 2004 seems to restrict the use of traditional messenger services (see Attachment "E").

10:50 – Carrier Best Practices
Darrell Sekin will introduce the issue of carrier policy vis-à-vis stress on the fulfillment of truck delivery services in through bills of lading (see Attachment "F").

11:05 – Developing Late File Penalty Guidelines
The Committee will consider the late file penalty guidelines for ACE developed by TSN Trade Engagement and provided to the Committee by Amy Magnus (see Attachment "G").

11:20 – Customs Bond Centralization
Bob Perkins will report on progress of the COAC Bond Centralization Subcommittee (see Attachment "H").

11:30 – EIP RLF Actual Use Merchandise Restriction
Administrative Message 06-0378 dated 03/28/2006 notified filers of a restriction on EIP and RLF relating to entry goods subject to actual use provisions (see Attachment "I").

11:40 – ACE Importer Portal Account Proxy
For some customs brokers the ACE Importer Portal Account may provide an opportunity to deliver enhanced customer services, including reports drawn from the importer's ACE database. The greatest degree of account functionality will be possible for customs brokers designated and authorized by the importer as the proxy ACE Importer Portal account owner. To enable this Customs Counsel has drafted a proxy owner appointment (see Attachment "J"). A standard customs power of attorney including pertinent language might also be used for these purposes (see Attachment "K")

11:50 – Truck eManifest
The Committee will review the summary of CESAC initiatives compiled by Stew Hauser (see Attachment "L") and the working group report received from Amy Magnus (see Attachment "M").
