Consultancy Services for formulation of the East African Court of Justice Strategy and

Implementation Plan 2016-2020

REQUEST FOR EXPRESSIONS OF INTEREST

Introduction

The East African Community (www.eac.int) is a regional inter-governmental organization of the five Partner States, namely; the Republic of Kenya, the Republic of Uganda, Republic of Burundi, Republic of Rwanda and the United Republic of Tanzania, with its Headquarters located in Arusha, Tanzania (www.eac.int).

The Court is the judicial arm of the Community. It was inaugurated on 30th November 2001, when the first batch of Judges and the Registrar were sworn in. The Judges were six (6) at the time, two Judges from each of the three initial Partner States of East African Community, namely, Kenya, Tanzania and Uganda.

The primary objective of the formulation process is to prepare a result-oriented EACJ integrated strategy with a medium-term Implementation Plan 2016-2020 that address the dictates of a regional/international Court of excellence, focusing on the Courts priority areas of intervention, taking into account new and emerging development challenges and opportunities facing the region.

It will also be necessary to review and or re-formulate the EACJ’s mission, vision and strategic objectives for the period 2016 – 2020 with due regard to the following parameters:

i.  The EACJ’s adjudication and Alternative Dispute Resolution (ADR) mandates.

ii. The increased visibility of the EACJ.

iii.  The EACJ’s prevailing functionality within the EAC’s operational framework in the short term.

iv.  The financial and administrative autonomy of the Court in the medium-long term.

The strategy formulation process would encompass all activities that are essential for the successful completion of the strategy documents in time and within the available resources. This will include but not limited to benchmarking the EACJ against sample regional/international courts and conduct a SCOR (Strength, Challenges, Opportunities, Risk) analysis of the courts operations, giving appropriate strategies for growth, increased visibility and risk management.

Throughout the process, series of planning, validation and consultative workshops and meetings would be convened to ensure the active participation of the EACJ, the Partner States, Members of the legal Affairs committee, Partners other stakeholders and obtain their inputs/contributions.

The EACJ now invites eligible (consulting firms) or individual consultants to indicate their interest in providing these services to formulate the EACJ Strategy and Implementation Plan 2016-2020.

Interested consultants or consulting firm) must provide information indicating that they are qualified to perform the services (brochures, description of similar assignments, evidence of experience in similar conditions, availability of appropriate skills among staff, etc.). Interested individuals or firms must provide the following information:

(i)  Experience:

Interested firms must have staff with General experience for the assignment with relevant academic qualifications in social sciences or development at the minimum level of Master’s Degree. The consultants must have at least 7 - 10 years of professional experience in his/her or their field. In addition the consultant must possess the following:

Firms:

·  Professional experience in development planning at policy as well as programme implementation level

·  Extensive consultancy experience in conducting similar assignments (knowledge and proven ability in strategic planning and programming areas)

·  Prior work experience with law, justice, judicial or related organisations EACJ/EAC Secretariat and relevant experience from working in the East African region

·  Comprehensive experience with Log Frame planning, results based management, monitoring and evaluation

·  Good communication skills and experience in conducting stakeholder workshops

Individual consultants

·  Extensive consultancy experience in conducting similar assignments (knowledge and proven ability in strategic planning and programming areas)

·  Prior work experience with law, justice, judicial or related organisations EACJ/EAC Secretariat and relevant experience from working in the East African region

·  Good communication skills and experience in conducting stakeholder workshops

(ii)  Proven experience in report writing.

(iii)  provide evidence of at least five (5) previous copies of contracts / orders of similar assignments and

Consultants may associate in the form of a joint venture or a sub-consultancy to enhance their qualifications. A shortlist will be developed from the firms or individuals
