RESOLUTION

RESOLUTION T-16286. USX CONSULTANTS (U-5399-C). REQUEST FOR VOLUNTARY REVOCATION OF CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY.

SUMMARY

This resolution revokes the Certificate of Public Convenience and Necessity (CPCN) of USX Consultants, Inc., as requested by the company.

BACKGROUND

USX Consultants, Inc. filed for its CPCN as a nondominant interexchange carrier in Application 94-02-035. Authority was granted in Decision 94-07-044. The company filed its tariff on July 29, 1994, and the tariff became effective on July 30, 1994. The company currently has no customers.

DISCUSSION

The company wrote a letter to the Commission on March 5, 1999, in which it requested that its CPCN be revoked. There is no reason to deny this request since there are numerous competitors of the company in the long distance market.

The Telecommunications Division recommends that the request for revocation be granted and that the company’s Utility Identification Number be cancelled.

This is an uncontested matter in which the resolution grants the relief requested. Accordingly, pursuant to PU Code Section 311 (g)(2), the otherwise applicable 30-day period for public review and comment is being waived.

FINDINGS

  1. USX Consultants, Inc. obtained its Certificate of Public Convenience and Necessity in Decision 94-07-044.
  1. The company requested that its CPCN be revoked in a letter to the Commission dated March 5, 1999.
  1. The company’s CPCN should be revoked and its Utility Identification Number should be cancelled.

THEREFORE, IT IS ORDERED that:

  1. The Certificate of Public Convenience and Necessity formerly granted to USX Consultants, Inc. is revoked.
  1. The company’s Utility Identification Number (U-5399-C) is cancelled and will not be reissued.

This Resolution is effective today.
