On motion of ______, seconded by ______, the following resolution was offered:
RESOLUTION NO.______
A resolution authorizing the Chairman of the Jefferson Parish Council, or in his absence, the Vice-Chairman, to execute the attached Wetland Mitigation Agreement between Jefferson Parish and Enterprise Woodlands, LLC, sponsor for Enterprise Woodlands Mitigation Bank, for the purchase of bottomland hardwood mitigation credits as required by the U.S. Army Corps of Engineers’ to compensate for the unavoidable impacts to jurisdictional wetlands associated with the implementation of Waggaman Drainage Improvements, Public Works Project No. 2005-017-DR at a cost not to exceed $50,000.00. (Council District No. 3)
WHEREAS, Jefferson Parish was required to apply for a coastal use permit with the U.S. Army Corps of Engineers to construct subsurface drainage improvements in Waggaman in the vicinity of the BNSF and Union Pacific Railroads between Modern Farms Road and Willswood Lane; and
WHEREAS, based upon the Corps’ review of the plans submitted by Jefferson Parish in connection with the Waggaman Drainage Improvements project, the Corps of Engineers has instructed Jefferson Parish to purchase mitigation credits from Enterprise Woodlands, LLC to compensate for the unavoidable impacts to jurisdictional wetlands associated with the implementation of the project; and
WHEREAS, Jefferson Parish has agreed to purchase and Enterprise Woodlands, LLC has agreed to sell, 0.7 acres of mitigation credits at a cost of $60,000 per acre, for a total sum of $42,000.00; and
WHEREAS, should 0.7 acres of mitigation credits be unavailable from Enterprise Woodlands, LLC at the time Jefferson Parish is ready to purchase said mitigation credits, Jefferson Parish shall purchase the required mitigation credits from another Corps-approved mitigation bank (e.g., Supple's Mitigation Bank) at a cost not to exceed $50,000.00.
NOW, THEREFORE BE IT RESOLVED by the Jefferson Parish Council, Jefferson Parish, Louisiana, acting as the governing authority of said Parish:
SECTION 1. That the Chairman of the Jefferson Parish Council, or in his absence, the Vice-Chairman, is hereby authorized to execute the attached Wetland Mitigation Agreement between Jefferson Parish and Enterprise Woodlands, LLC, sponsor for Enterprise Woodlands Mitigation Bank, for the purchase of bottomland hardwood mitigation credits as required by the U.S. Army Corps of Engineers’ to compensate for the unavoidable impacts to jurisdictional wetlands associated with the implementation of Waggaman Drainage Improvements, Public Works Project No. 2005-017-DR at a cost not to exceed $50,000.00.
SECTION 2. That the Council Chairman or, in his absence, the Vice-Chairman, is authorized to execute and approve the attached Wetland Mitigation Agreement and any and all other documents necessary to carry out the provision of this resolution, for purposes of complying with the U.S. Army Corps of Engineers mitigation requirements for Waggaman Drainage Improvements.
SECTION 3. That payment for the aforesaid purchase from Budget Account No. 45230-4039-7699.9(52369.003) is hereby authorized.
SECTION 4. That should 0.7 acres of mitigation credits be unavailable from Enterprise Woodlands, LLC at the time Jefferson Parish is ready to purchase said mitigation credits, Jefferson Parish shall purchase the required mitigation credits from another Corps-approved mitigation bank at a cost not to exceed $50,000.00.
