Buyer’s Agreement and Seller’s Guarantee
Double Yew Farm, the seller, guarantees that the Polish Tatra Shepherd dog purchased by the buyer, ______, will be free of any major genetic defects and will have a protective temperament at maturity (24 to 36 months), providing that the buyer raised the dog in an appropriate environment. What the dog protects will depend on the manner in which the dog is raised and is the responsibility of the buyer upon consultation with the seller. A dog that fails to protect satisfactorily after appropriate training, or a dog bought for breeding purposes with a serious genetic defect will be replaced or a refund will be offered (see details below).
The seller will provide a dog or puppy to the buyer in healthy condition with current vaccinations, and will guarantee good health for two weeks after the sale. The buyer is responsible for providing proper veterinary care, vaccinations and nutrition to the dog thereafter.
The litter will be registered with both the United Kennel Club and the American Rare Breed Association. Buyer must transfer owner ship through one or both of the clubs. The registered name must contain Double Yew Farm as part of the name. If the dog will be used for breeding, the buyer must have the hips and elbows radiographed within 6 months of the dog’s second birthday. The radiograph must be submitted for evaluation and certification by the Orthopedic Foundation for Animals (OFA) located in Columbia, Missouri. Dogs used in a breeding program must also have their eyes certified.
The buyer agrees to only breed their Polish Tatra to another purebred Polish Tatra. The buyer will not breed a dog that has genetic problems such as hip dysplasia. Any pups born showing serious problems or deviations from the breed standard must be neutered and not used for breeding.
The buyer agrees to use discretion in placing her/her pups or adults should he/she decide to breed Livestock Protection Dogs. This is a working breed and must be placed with people who realize that this is a large, guard dog that requires space and firm handling. Companion dog owners must provide safe fencing for their dog when he is left unattended out of doors, to protect the dog from injury to himself and innocent people and animals outside the owner’s property. These dogs tend to have a large sense of territory and must be safely controlled at all times.
The buyer agrees not to sell nor to give away their dog to any individual or organizational representative who is not willing to enter into an AGREEMENT similar to this one. Prior to relocating a dog, the buyer will inform the seller and give them the first option to take the dog. The buyer should also be willing to guarantee any dog that he/she places.
The buyer agrees to notify the seller of any serious problems with the dog that may be inherited or have a heritable component. These include osteochondrosis (OCD), hormonal imbalances, susceptibility to skin conditions, gastric torsion, autoimmune disorders, etc.
The buyer must notify the seller of any physical or temperamental problems as soon as they become apparent in order to be eligible for a future replacement or refund. A dog that has been overfed and deemed overweight by a veterinarian any time prior to three years of age will not be guaranteed against any orthopedic defects, including hip dysplasia. As a note, please remember to feed your puppy appropriate food that is not too high in protein. These dogs should be fed to accommodate slow steady growth instead of fast growth. Strive for constant, slow gains and you will have the best chance of preventing undue stress on growing bones and joints. These dogs grow over a period of YEARS, and typically don’t achieve full growth and filling out until about their third year. Don’t rush them!
Causes for replacement or partial refund for dogs that have not been overfed, supplemented or inappropriately exercised would be: OFA hip and elbow rating below Fair; heritable eye diseases such as retinal atrophy or non-traumatic entropion, distinctly overshot or undershot bite; undescended testicle(s); sterility unrelated to accident or disease; extreme shyness; no protective behavior (when appropriate). Seller will decided whether to offer replacement dog or a partial refund so the purchase price is reduces to that of a dog not eligible for breeding. A buyer may decide if they do not wish to take a replacement dog.
Other disorders or problems not mentioned in the above lists that result in surgery, ongoing medical expenses and/or seriously compromise the dog’s quality of life and/or the ability to guard may also be considered causes for replacement.
Replacement shall be made as soon as possible upon receipt of documentation from a licensed veterinarian that the defective animal has been spayed or castrated. The buyer is responsible for all veterinary expenses and the cost of shipping the replacement puppy. In the event of any type of corrective surgery for hip dysplasia, entropion, etc., the seller must be notified immediately upon diagnosis and reserves the right to request a second opinion from a veterinarian not associated with the first, review radiographs and confer with other veterinarian before any surgery is performed. If the above condition are not met, the seller assumes no responsibility for providing a replacement.
Refund of purchase price is justified if a dog must be euthanized or dies naturally within the first two years of life due to disease acquired at Double Yew Farm or an inherited condition, as documented by a licensed veterinarian, and the buyer does not wish to take a replacement dog.
