Amy Cotton Peterson is chair of Quarles & Brady's Health Law Practice Group. As a licensed physical therapist and health care attorney, she has a unique perspective on issues that face health care providers and entities. Her practice focuses on health care transactions, regulatory and compliance issues, business development and provider defense. Her relevant experience includes:
Health Care Transactions:
- Represent buyers, sellers, and investors in the sale or purchase of health care entities or lines of business
- Assist with all regulatory licensure and registration issues related to health care transactions
- Drafting and negotiating agreements relating to the purchase or sale of entities or lines of business, network participation agreements, business associate agreements, pharmacy services agreements including shared services, central fill and other novel programs, specialty pharmacy service agreements, marketing and consulting agreements, service agreements, drug rebate and discount agreements and other health care related agreements;
Regulatory Compliance:
- Pharmacy
- Advising pharmacies, wholesalers, PBMs and manufacturers on licensure requirements and complex regulatory compliance issues;
- Advising discount medical plan organizations on regulatory and compliance issues;
- Genetic Testing
- Privacy and regulatory issues related to genetic testing and genetic information
- Privacy
- Advising clients on compliance with health privacy and security laws including HIPAA and state privacy laws.
- Development of electronic prescribing and electronic health records
- Health Care Compliance
- Guiding clients in compliance with federal Stark, and federal and state Anti-Kickback, and False Claims Act laws and regulations.
- Compliance with physical therapy and rehabilitation laws and regulations
- Compliance with Medicaid and Medicare programs and guidance regarding audits and CMS marketing guidelines
- Privacy and regulatory issues related to clinical trials
- Advising clients regarding multi-disciplinary health care practice regulation and structure
- Guidance related to corporate wellness programs and on site medical clinics, and telemedicine
- Advising clients regarding the Corporate Practice of Medicine
Provider Defense:
- Representing health care providers before professional licensing boards, including Pharmacy Boards, Physical Therapy Boards, Medical Boards, Nursing Boards, Dental Boards, Boards of Chiropractic Examiners, Behavior Health Boards, Optometry Boards
- Advising clients related to usual and customary pricing issues and defense of state and federal qui tam challenges to drug pricing and reporting.
- Drafting voluntary disclosures
- Assistance with FDA, DEA and OIG investigations
Business Operations and Development:
- Counseling clients through internal investigations
- Develop compliance programs for entities operating in multiple states;
- Drafting policies and procedures related to compliance, privacy and other health care business activities
- Obtaining regulatory approval or waivers for novel business initiatives
