Council Meeting December 30, 2004

Council Chambers:

ROLL CALL: The City Council of Lincoln Center convened in special session at 7:30 a.m. with Mayor Del Vignery presiding. Councilmembers present: D. Leon Kingan, Craig L. Ledet, Arletta R. Morse, Glenn M. Stegman. Councilmember Marion L. Florence arrived at 7:37 a.m. Officials present: Attorney Daniel D. Metz, Clerk Rose M. Gourley.

MINUTES: Minutes of the December 13, 2004, regular meeting, were approved as written.

PAYROLL VOUCHER: Payroll Voucher No. 04-12, for December wages and salaries in the amount of $40,154.21, was presented. Included in the total was the reimbursed Library payroll totaling $1,716.54, leaving a net City payroll of $38,437.67. A motion by Ledet, seconded by Morse, to approve said Payroll Voucher, carried.

ACCOUNTS PAYABLE: A list of December Accounts Payable to date, containing invoices in the amount of $20,763.51, was presented and reviewed. Upon motion by Stegman, seconded by Kingan, all said invoices were approved for payment.

BEER LICENSES: Applications for renewal of Cereal Malt Beverage Licenses had been received from Mity Mart, Inc.; K K Smith, Inc., d/b/a Lincoln Grocery; Patricia A. Moore, d/b/a/ Extra Innings Barbeque; and Pizza Hut of Osborne, Inc. All applications were accompanied by the appropriate fees. Clerk Gourley explained that the Pizza Hut License was moved from Lincoln County’s jurisdiction this year due to the annexation of the property into the City. There followed a motion by Stegman, seconded by Ledet, to issue 2005 Cereal Malt Beverage Licenses to all said applicants. Motion carried.

TRANSFER FUNDS: A motion was made by Stegman, seconded by Ledet, to transfer $50,000.00 from the General Fund to the Special Equipment Fund. Motion carried.

BOUNDARY RES. #04-08: Resolution No. 04-08, entitled “A RESOLUTION DECLARING THE BOUNDARIES OF THE CITY OF LINCOLN CENTER, KANSAS,” as approved at the December 13, 2004, City Council meeting, was made available in its final form.

BURN PRMT ORD. #654: City Attorney Metz presented an ordinance entitled “AN ORDINANCE AMENDING ORDINANCE NO. 553, SECTION 6 AND CORRESPONDING SECTION 7-204 OF ARTICLE 2 OF THE CODE OF THE CITY OF LINCOLN CENTER, KANSAS, PERTAINING TO OPEN BURNING ON PUBLIC OR PRIVATE PROPERTY WITHIN THE LIMITS OF THE CITY OF LINCOLN CENTER, PROHIBITING CERTAIN ACTS AND PROVIDING FOR PERMITS RELATING THERETO.” The Ordinance would provide an amendment to the prohibition on open burning in the City of Lincoln Center, allowing for a permit procedure, fire chief notification, and law enforcement notification. Stegman moved to pass said Ordinance. Motion seconded by Kingan. Upon call for vote, the following Councilmembers voted Aye: Florence, Kingan, Ledet, Morse, Stegman. Nay: None. The Ordinance was declared passed, was assigned #654 by the City Clerk, approved and signed by the Mayor, and ordered to be published once in the official city newspaper.

HOUSING DEVELOPMENT: Correspondence from the Kanopolis Satellite Office of the US Army Corps of Engineers indicated revised development plans had been reviewed, and the residential development project adjacent to Yauger Creek would be authorized by Nationwide Permit 39.
