Instructions for filing a Motion to Establish Parenting Plan
with a Proposed Parenting Plan
READ DIRECTIONS COMPLETELY.
- Complete the following form pleadings fully, legibly, and accurately.
- Motion to Establish Parenting Plan
- Certificate of Mailing
- Proposed Parenting Plan
- Notice of Hearing (See #5 and #6 below.)
- Find a notary public to notarize the Motion in the Verification section.
- Make three copies of the ORIGINAL notarized and signed Motion and Proposed Parenting Plan:
- The original shall be retained by the Clerk of the District Court. (See #4 below.)
- One copy shall be served on the Division your case is in.
- One copy shall be served on the other party or the other party’s attorney.
- One copy shall be retained for your personal records.
- File the Motion and your Proposed Parenting Plan with the Clerk of the District Court on the second floor of the Johnson County Courthouse. The Clerk will file-stamp all copies of the documents and keep the originals.
- Take a file-stamped copy of your Motion and Proposed Parenting Plan to the Division your case is assigned to and obtain a hearing date from the administrative assistant. You will most likely be required to go to mediation before having a hearing. You can obtain an Order for Mediation from the administrative assistant. If there is an attorney on the other side you may have to coordinate the hearing date with the attorney. The administrative assistant will NOT give you a hearing date until the motion has been officially filed.
- Fill out the Notice of Hearing with the date and time acquired from the administrative assistant. File the Notice of Hearing with the Clerk of the District Court.
- Mail a file-stamped copy of the Motion to Establish Parenting Plan, Proposed Parenting Plan, and Notice of Hearing to the other party in your case within one day of filing the motion as shown in the “Certificate of Mailing.” If the other party in your case is represented by an attorney, you must mail a copy of the motion to that party’s attorney as well.
NOTE:
IT IS YOUR RESPONSIBILTY to know and follow court rules. The Court cannot make exceptions for people without attorneys. You could hurt your case if you do not follow the correct procedures. Familiarize yourself with the rules and laws that apply to your case.
IT IS YOUR RESPONSIBILITY to get the correct papers filed and proper service completed, in order for your case to go forward on its assigned hearing date and time. However, keep in mind that using court forms does not automatically guarantee that you will get what you want. You should talk to an attorney if you do not know which form to use, what to write on a court form, or what to do with the form.
