TO ALL PARTIES:

On January 27, 2017, Administrative Law Judge Steven K. Haas issued an Order denying the Motion of the Commission’s Bureau of Investigation and Enforcement (I&E) to bifurcate the above-captioned proceedings. On January 30, 2017, I&E filed a Petition for Expedited Interlocutory Review, Stay of Proceedings, and Answer to Material Questions (Petition). I&E requests, in part, that the time period for submitting briefs related to the Petition be shortened to five days.

Our Regulation at 52 Pa. Code § 5.302(b) permits a party to submit a brief supporting or opposing a petition for interlocutory review and answer to material question within ten days of service of the petition. In its Petition, I&E indicates that evidentiary hearings in this proceeding are scheduled for February 16, 2017, and February 17, 2017. In light of the scheduled evidentiary hearings and cognizant of the compressed time line discussed in the Commission’s Implementation Order at Docket No. M-2016-2543193, we shall modify the time period for filing briefs in support of or opposition to the Petition. Specifically, briefs must be received by the Secretary’s Bureau by 4:30 p.m. on Monday, February 6, 2017. In addition, courtesy copies of the briefs should be e-mailed, in Microsoft Word 2010 format (or other compatible format), to the Office of Special Assistants at . Following the submission of any briefs, the remainder of the Petition, including the request for a stay of the proceedings, will be addressed by the Commission in a subsequent Opinion and Order.
