purpose:This unit standard is for animal control officers. People credited with this unit standard are able to demonstrate knowledge of legislation relating to the classification of menacing dogs, and describe processes for the classification of menacing dogs.

Elements and Performance Criteria

element 1

Demonstrate knowledge of legislation relating to the classification of menacing dogs.

performance criteria

1.1Section 33A of the Dog Control Act 1996 is described in terms of intent, and contrasts between 33A (1) (b) (i) and 33A (1) (b) (ii) are identified.

1.2Section 33C of the Dog Control Act 1996 is described in terms of intent.

1.3Breeds of dog and type of dog listed in Schedule 4 of the Dog Control Act 1996 are identified.

1.4The five conditions which the owner of a menacing dog must comply with are identified, along with applicable timeframes.

1.5Penalties for owner non-compliance with requirements of the menacing dog classification are identified.

Describe processes for the classification of menacing dogs.

performance criteria

2.1Description includes process for classifying a menacing dog that is registered as one of the breeds or type listed in Schedule 4 of the Dog Control Act 1996.

Range:includes but is not limited to – letters, visits.

2.2Description includes process for classifying a menacing dog which is not registered as one of the breeds or type listed in Schedule 4 of the Dog Control Act 1996 but otherwise meets the requirements of the menacing dog classification under section 33 of the Act.

Range:based on behaviour, based on predominant characteristics;

includes but is not limited to – letters, visits, identification process, gathering of evidence.

2.3Description includes appeal process the dog owner can go through if they do not agree with the menacing dog classification.

Range:parties, order of events, any set timeframes.
