Employer Information Request (H-1B)

  1. What is the company name?
  1. What is the company address?
  1. What is the company’s phone/fax/email?
  1. What is the name/job title of person who will sign the H-1B petition after it is prepared by the attorney?
  1. What is the company’s federal employer id number?
  1. What is the address where the beneficiary will work if different from address in #2?
  1. What is the company’s type of business? (eg. Clothing manufacturer, Engineering services, International trade, etc.)
  1. Introduction of your company (website address? Or attach a company brochure, product catalog, etc.)
  1. What year was the company established?
  1. What is the current number of employees?
  1. What is the company’s gross annual income shown in its most recent tax return?
  1. What is the company’s net annual income shown in its most recent tax return?
  1. What is the offered wage to the beneficiary? (eg. $15.70 per hour, $2,500 per month, $36,000 per year, etc.)
  1. Is there any other compensation to the beneficiary such as 401k, health insurance, etc? (If yes, please explain what they are)
  1. Please briefly explain the beneficiary’s job title and job description.

Company Document Request (all document will be kept strictly confidential.)

  1. Company’s brochure, information booklet, product catalog, if available.
  2. Company’s letterheads (about 20 blank sheets for us to draft the company’s petitioner letter) We understand that some companies do not give out blank letterheads. In such cases, we will forward the draft of the petitioner letter electronically via email which can be printed by the company on its letterheads and sent back to us.)
  3. Evidence of company’s legitimate creation and legal existence (these can be copies of business license, articles of incorporation or both)
  4. Evidence of company’s financial ability (these can be copies of company’s most recent income tax returns, and/or audited financial statement) (This is almost always requested by USCIS.)
  5. Evidence of company’s physical location (eg. Copy of lease agreement) (This is not always but very often requested by USCIS.)
  6. Evidence of how many employees (eg. Copies of most recent Form DE-6 and Form 941 Quarterly Wage Report) (This is not always but very often requested by USCIS.)
  7. Company’s organizational chart (name/position and brief description of the position) (the persons shown on the organizational chart should be company’s official employees.)

Attorney fee & USCIS fee:

Please note that the fee involved with H-1B filing is the responsibility of the sponsoring employer, not the beneficiary.

How much?

* Attorney fee is $2500 for H-1B case ($1500 initially and $1000 after approval)

Initial Fee due

So, the initial fee due at the beginning is as follows: (Please use separate company checks for each of following)

* Initial attorney fee $1500 (payable to Law Offices of Jim Kahng)

* USCIS fee $325 for Form I-129 filing (payable to Department of Homeland Security)

* USCIS fee $500 for fraud prevention fee (payable to Department of Homeland Security)

* USCIS fee $750 for Form I-120 ACWIA (American Competitiveness & Workforce Improvement Act) fee (payable to Department of Homeland Security)

Additional (or optional) fee as applicable: (Please use separate company checks and for each of following)

* Additional USCIS fee $750 if the sponsoring employer has more than 25 employees (payable to Department of Homeland Security)

* Additional USCIS fee $290 if the H-1B beneficiary has a dependent spouse or children who are applying together as H-4 dependent family members ($290 one fee for all dependent family members regardless of how many) (payable to Department of Homeland Security)

* Additional USCIS fee $1225 for Form I-907 for Premium Processing (payable to Department of Homeland Security)

Foreign University Graduate

* $100 fee payable to Law Offices of Jim Kahng (this check may be a personal check), if you graduated from foreign university

Any Other Fee?

* After approval, we will bill you for the Fedex postage cost.
