RESIGNATION AGREEMENT
between

(hereinafter referred to as "the Employer")
and
xxxxxxxxxxxxxxxxxxxxxx
(MALAWI PASSPORT NUMBER: )
(hereinafter referred to as "the Employee")
With reference to the meeting between the Employer and the Employee on 7 March 2013, and by mutual agreement and in the interests of both parties it has been agreed that the Employer will accept the Employee’s voluntary resignation from the Employer with immediate effect.
1. The Employee shall receive the following amounts due to him as a consequence of his resignation:
1.1 A settlement payment in the sum of R750.00 for 1 week worked in March 2013.
2. The Employee agrees that the payments as set out above will be paid to him in full and final settlement of all claims of whatsoever nature that he may have against the Employer and he hereby holds harmless the Employer, agents and employees of the Employer, from any claim or liability arising out of any cause whatsoever including but not limited to any claims arising out of equity, contract, delict or the South African Constitution and/or the Labour Legislation (as amended).
3. This agreement will act as a novation of any employment relationship between the parties, and will have the effect that the employment relationship is replaced in its entirety by this agreement.
4. The conditions as set out in this agreement embody all the terms agreed on between the parties in respect hereof, and no alteration to or of this agreement will be binding on either party, unless it is reduced to writing, and signed for or on behalf of both parties.

who by his signature hereto acknowledges that he has entered into this agreement freely and voluntarily, that he has read and understands the terms of this agreement, and that he binds himself to all the terms contained herein.
