  • Any Agent wishing to obtain Internet access to the LCBO’s In-Store Experience Programs System for the purpose of submittingIn-Store Tastings or Special Events applications to the LCBO must complete and submit this application.
  • Thisapplication, if accepted by the LCBO, sets out terms and conditions that will apply regarding your use of the In-Store Experience Programs System.
  • Application must be completed in full and signed by an authorized signing officer of the Applicant.

APPLICANT INFORMATION

The email address of the authorized signing officer of the Applicant should include the name of the Applicant Company (for example – [email protected]). If the Applicant does not have an Internet domain name, you may use a different email address.

Upon acceptance of the application by the LCBO, the LCBO will notify the Applicant via email of all user name(s) and password(s) assigned to the Applicant. In consideration of the LCBO allowing the Applicant to access the In-Store Experience Programs System (if granted) the Applicant agrees to abide by the terms and conditions included in this document, which form part of this agreement.

REGISTRATION INFORMATION:

Complete this section with the details of the employees of the Applicant for whom you require usernames to access the In-Store Experience Programs System. Usernames and passwords enable a user to submit applications on behalf of the Applicant to participate in LCBO In-Store Experience Programs described in the LCBO’s General Purchase Programs under Experience Programs. Each username will enable the authorized user to view information submitted by the Applicant regarding In-Store Tastings and Special Events to the LCBO.

Each authorized user will receive a unique username to be used by that person only.

The email address stated for each authorized user should include the name of the Applicant company (for example –[email protected]). If the Applicant does not have an Internet domain name, you may indicate a different email address. The LCBO may contact the Applicant to authenticate the identity of the authorized user in such a case.

The Applicant must identify employees who are authorized to have access to the In-Store Experience Programs System at any given time.

If your application is accepted, the Applicant (“you”) agrees to and is bound by the following terms and conditions. This agreement shall come into effect only when the LCBO indicates its acceptance (if any) of this application by issuing you user name(s) and passwords(s).

  1. With your user names and passwords, you will be able to electronically access the LCBO’s In-Store Experience Programs System to submit applications for In-Store Tastings or Special EventsServices that the LCBO makes available from time to time. This Agreement sets out the terms and conditions under which you are permitted to use the In-Store Experience Programs System.
  1. You may apply for In-Store Tastings or Special Events Services by submitting an application electronically using the In-Store Experience Programs System or any other application document that the LCBO specifies.
  1. The In-Store Tastings or Special Events Services that are available, the terms and conditions that apply to the In-Store Tastings or Special Events Services, and the LCBO’s fees and charges for In-Store Tastings or Special Events Services are described at the LCBO’s Trade Resources Web Site (). The Applicant acknowledges that he/she has read and understands the current terms and conditions that apply to the In-Store Tastings or Special Events Services available from the LCBO.
  1. The LCBO reserves the right, in its sole discretion, to modify the terms and conditions applicable to the In-Store Tastings or Special Events Services (including, without limitation, the applicable charges) at any time. Any changes in the terms and conditions applicable to In-Store Tastings or Special Events Services shall be deemed to be effective when they are published by the LCBO on the LCBO’s Trade Resources Web Site or otherwise communicated to you in another document or format. You understand that you are responsible for reviewing the applicable terms and conditions whenever you submit an application for In-Store Tastings or Special Events Services.
  1. The LCBO reserves the right, in its sole discretion, to accept or reject, in whole or in part, any application for In-Store Tastings or Special Events Services submitted by the Applicant.
  1. Without limiting the provisions of section 4, the LCBO reserves the right to amend the fees and charges for In-Store Tastings or Special Events Services from time to time. Where an application for In-Store Tastings or Special Events Services submitted by the Applicant has been accepted by the LCBO, the Applicant agrees to pay all applicable fees and charges in effect at that time (unless other compensation arrangements have been mutually agreed upon).
  1. The LCBO reserves the right in its sole discretion: (i) to limit the time period during which access to the In-Store Experience Programs System will be made available; (ii) to modify the manner in which it makes access to the In-Store Experience Programs System available; (iii) to modify or discontinue any In-Store Tastings or Special Events Services, and (iv) to cancel this agreement, at any time.
  1. You may apply for user names and passwords for more than one individual. Each such user name and password is to be used by a single person in your organization. You confirm that you grant authority to all such individuals who are given user names and passwords to legally bind you. The LCBO will consider all applications for In-Store Tastings or Special Events Services that are submitted using your user names and passwords to be duly authorized by you. You will be bound by all information, applications and other instructions submitted to the LCBO through the In-Store Experience Programs System using your user names and passwords. You agree that you will keep your user names and passwords confidential. You are responsible for the security of your user names and passwords. You agree to follow such procedures, controls, instructions and guides as the LCBO may reasonably require (and in the absence of any specified requirements, to use commercially reasonable controls and procedures) in connection with the In-Store Experience Programs System. Your user name(s) and password(s) will enable a user to submit applications for In-Store Tastings or Special Events Services and to make full use of all related features.
  1. You are responsible for: 1) all activities that occur using your user names and passwords, 2) notifying the LCBO of any unauthorized use of any of your user names or passwords. You agree to notify the LCBO promptly of any changes in the registration information at the beginning of this agreement to ensure that it is kept accurate and complete.
  1. The LCBO is authorized to accept and act upon requests to change the authorized users (such as requests to delete or add additional authorized users for your organization) when they have been received in writing.
  1. The LCBO’s records will, in the absence of obvious error or otherwise agreed by us, be conclusive evidence of the information the LCBO receives and the transactions between the Applicant and the LCBO resulting in the Applicant’s use of the In-Store Experience Programs System.
  1. THE LCBO SHALL NOT BE LIABLE FOR ANY DELAY OR FAILURE TO PROVIDE ACCESS TO THE IN-STORE EXPERIENCE PROGRAMS SYSTEM, FOR ANY REASON WHATSOEVER INCLUDING, WITHOUT LIMITATION, SYSTEMS FAILURE OR TECHNOLOGICAL FAILURE OF THE LCBO’S WEB SITE OR THE WEB. IN NO EVENT WILL THE LCBO BE LIABLE FOR DAMAGES IN RESPECT OF SPECIAL, INDIRECT OR CONSQUENTIAL LOSS, EVEN IF THE LCBO HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST BUSINESS REVENUES, FAILURE TO REALIZE EXPECTED BUSINESS OPPORTUNITIES OR ANY CLAIN AGAINST YOU BY ANY THIRD PARTY. THE WARRANTIES OF THE LCBO HEREUNDER ARE IN LIEU OF ALL OTHER WARRANTIES OR CONDITIONS OF MERCHANTABLE QUALITY OR FITNESS FOR A PARTICULAR PURPOSE AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE.
  1. You will not access or try to access restricted areas of the LCBO’s computer system or perform functions that are not authorized under this agreement or to disrupt, impair or interfere with the LCBO’s computer system. If the LCBO reasonably suspects that you are doing so or attempting to do so, then the LCBO may cancel this agreement without notice to you.
  1. This agreement is governed by and shall be construed in accordance with the laws of the Province of Ontario.
