October 12, 2016

The meeting was held at the Department of State, 99 Washington Avenue, Albany; 65 Court Street, Buffalo; and, 123 William Street, NYC.

  1. CALL TO ORDER, INTRODUCTIONS and OFFICIAL ATTENDNACE

Michelle D’Allaird called the meeting to order at 10:32 am. Roll call was performed and announced there was a quorum. Anthony Fiore was welcomed as a new Board Member.The official attendance was as follows:

AEAC 51412 meeting summary

  1. DEPARTMENT REPORTS

Enforcement Update - E. Gantt reported on the 2016 Appearance Enhancement Enforcement Initiative whereby 25% of all businesses will be inspected. She stated the Department is partnering on the initiative with the Department of Labor; Department of Taxation and Finance and Worker’s Compensation Board.

Trends Committee–D. Tidings summarized the subcommittees meeting whereby some current procedures/equipment/productswere discussed and their attempt to determine if they fall, or should fall, within the scope of an Appearance Enhancement license or another category. The board was provided a written outline of the meeting notes and encouraged to submit their comments in writing to the Department. The committee will meet again to discuss any questions or ideas the board submits.

Cosmetology/Shampoo Assistant–D. Tidings summarized the subcommittees meeting regarding the Cosmetology/Shampoo Assistant proposal. The board was provided a written outline of the meeting notes and proposal. The board members expressed concerns and questions. They requested the subcommittee meet again and discuss some of the boards concerns before the next board meeting. The board was encouraged to submit their comments in writing to the Department. D. Shapiro advised that legislation would be required before the proposal could move forward.

  1. ACTION ITEMS

A motion was made to approve the meeting summary of May 25, 2016. Motions were made and the meeting summary was unanimously approved.

  1. NEW BUSINESS

Ventilation Regulations & Industry Update – D. Shapiro stated the new ventilation regulations became effective October 3, 2016 for new Nail Salon businesses. Businesses licensed prior to October 3 would be permitted 5 years to become in compliance. The Department has met with several industry associations to explain the new ventilation regulations and has also updatedour website with this information.

  1. PUBLIC COMMENT PERIOD

A public member voiced concerns about the Cosmetology/Shampoo Assistant proposal. A public member posed questions about the new ventilation regulations for new construction which were answered by D. Shapiro and A. Penzabene.
