5.Council action -Staff recommends that the City Council of the City of Rio Vistaadopt Resolution No. ______, “Adopting the 2010 Urban Water Management Plan”.

BACKGROUND

On December 15, 2005 the City Council of Rio Vista approved the 2005 Urban Water Management Plan (UWMP) as required by California Water Code Section 10644(a).A new UWMP is required every five years per California Water Code Section 10644(a) to be adopted and implemented. The process involves public review of the UWMP, any revisions, and adoption by the governing body of the agency.

The UWMP document contains various sections of data and information regarding the production and uses of potable water for the City, and its management of that potable water. There are sections that talk about ground water management, availability of ground water, and the conservation of ground water through out the City.

There are sections that talk about landscape irrigation conservation and monitoring, irrigation water efficient ordinances, and other conservation measures.

The City’s 2010 UWMP shall be reviewed by the City Council and general public during the public hearing meeting. The UWMP shall be reviewed and/or revised as needed to address comments and concerns prior to adoption by the City Council. Once adopted by the City, UWMP shall be submitted to the Department of Water Resources by July 1, 2011.

REVIEW AND ANALYSIS

The UWMP was due to be submitted by July 1,2011to the Department of Water Resources. City staff completed the review of the draft UWMP, commenced to have the Public Notice for the Public Hearing set for June 16, 2011, and has been continued to August 18, 2011, to allow for the necessary time for the public to review the document.

The City Attorney has been in contact with the developers of Del Rio Hills Project and have been able to incorporate their comments, concerns, and questions into the final draft document.

Staff has incorporated its revisions along with those of our City Engineer, Dillon and Murphy Consulting Civil Engineers. The UWMP is now ready for the City Council and the public to review and comment as needed. Staff recommends the UWMP be adopted with any revisions to be made as noted in the public hearing.

Solano County Water Agency was also contacted 60 days prior to the public hearing to review the 2010 UWMP, and will receive a final copy 30 days after the submission of the 2010 UWMP to the California Department of Water Resources as per California Water Code Section 10621(b) and Section 10635(b). The City received no comments back from Solano County Water Agency.

The 2010 UWMP will be sent to the Department of Water Resources, the California State Library, and SolanoCountywithin 30 days of adoption by the City of Rio Vista City Council as per California Water Code Section 10644(a).

FINANCIAL CONSIDERATIONS

Once adopted by the City Council, there will be a need in the future to implement water conservation education and outreach programs to the community, inspect irrigation and landscape installations as required per irrigation and water efficiency ordinance. Any costs associated with these proposed programs have not be determined yet, depending final review by the Department of Water Resources staff.

ALTERNATIVES

Do not adopt the 2010 UWMP as presented, and do not authorize staff to send the 2010 UWMP to the State of California Department of Water Resources. Staff does not recommend this alternative, because the State can fine the City for non-compliance to State Water Code Section 106449(a).

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIOVISTA

ADOPTING THE 2010 URBAN WATER MANAGEMENT PLAN

WHEREAS, the State of California requires an Urban Water ManagementPlan (UWMP) also be prepared per California Water Code Section 10620(e); and

WHEREAS, Dillon and Murphy Consulting Civil Engineers has prepared an UWMP in accordance within State requirements; and

WHEREAS, the City Council acknowledges that minor changes maybe made and maybe required prior to submission of the UWMP tothe State.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIO VISTAthat said Council does hereby approve the UWMP, subjectto minor changes as maybe necessary.
