2. Subject of Public Procurement
Subject of this public procurement is construction and commissioning of Primary School in Podgorica – settlement of Drac. The tendered works include building works, construction trades, installations (water and sewage system, electrical works and heating ventilation and air-conditioning) and commissioning of Primary School the Contractor shall execute in accordance with the Final Design and pursuant to types and scope defined in Tender Documents.
Public procedures will be implemented as a single whole with an option of implementation of procedure set in Article 23, Item 4 of the Public Procurement Law (OJ of RoM No 46/06).
Invitation is opened in accordance with the Agreement signed between the Government of the Republic of Montenegro and the Government of the Republic of Hungary to any tenderer with registered office in the Republic of Hungary provided the leading company shall be a company with registered office in Hungary – not less than 50% of export shall be realized by companies registered in Hungary, while subcontractors or suppliers can be companies out of the territory of Hungary. Shall a tenderer fail to meet this requirement respective tender shall not be subject to consideration.
3. The public procurement does not anticipate signing of the Framework Agreement
4. Net estimated value of the said public procurement is 3.250.000,00 €
5. Any tenderer applying for tender shall provide following substantiated documents proving:
Tenderer has not been sentenced for criminal acts envisaged by this law nor has been convicted with a prohibition of performing activities entering into scope of this public procurement;
Tenderer possesses business – professional capacity and
Regularly fulfils liabilities due for taxes and contributions
Evidence of fulfillment of the mandatory requirements set forth in this Item shall be submitted in a material and form as defined by Article 51 of the Public Procurement Law as down indicated:
- Tenderer has no criminal record under governance of this law. The tenderer is not sentenced with prohibition of performing activities entering the scope of this public procurement (Article 46 of the Public Procurement Law, OJ of the Republic of Montenegro No 46/06) – Excerpt from criminal register or equivalent certificate issued by a competent authority
- Excerpt from court, professional or trade register of the state the company is registered in or valid license meaning licenses issued by a competent authority for professional performance of the activity concerned
-Evidence that legal person has not gone bankrupt or being under liquidation procedure – certificate issued by court or competent authority of the state of registration of the company
-Evidence that there is no suspension of payment to tenderer – an adequate bank excerpt, certificate or statement on financial eligibility issued by a business bank of a legal person.
- Evidence issued by a competent authority in charge of taxation and pension and health insurance that there are no outstanding liabilities for tax and contributions.
Along with the above-mentioned evidence Tenderer shall provide proofs of
1) Economical-financial Eligibility
1.1. Report on accounting and financial position e.g. Balance Sheet, Profit and Lost account, that is to say Report by authorized Auditor when prescribed by certain Law regulating matters of accounting affairs and auditing, for the period of last three years
2) Expert and Technical Capacities and Human Resources
2.1. List of previous contracts of similar nature and complexity
2.2. List of current contract commitments/ works in progress
2.3. Key Personnel Capabilities
2.4. Candidate Summary
2.5. Available man force
2.6. Expert staff to be engaged in execution of the contract
2.7. Organization of man force to be engaged in execution of the contract
2.8. Organization, type and scope of building machines and equipment,
2.9. List of subcontractors and partners,
2.10. License for construction of this type of structures based on the Law on Construction, Article 40 (OJ of RoM No 55/2000) and
2.11.Statement – Agreement on any intention and subject of a subcontract
Should a tenderer fail to furnish any of the proof of eligibility defined in the Invitation to tender and Tender Documents, respective tender shall be rejected as substantially non-responsive.
6. Submission of alternative tenders is not allowed
7. Criterion for selection of a successful tender is economically most effective tender with the following sub-criteria shown in a descending sequence:
- Tender Price 70 points
- Delivery Date 5 points
- Technical and technological capacities25 points
8. Tender Documents can be obtained at Directorate for Public Works every working day from 8 am to 4 pm starting with July 12th 2007. Tender documents for tender procedure will be issued by Public Procurement Officer upon receipt of evidence of payment of EURO 2.000 to the gyro account of Directorate for Public Works, account No 832 – 1029 –20 indicating purchase of tender document as a reference.
9. Tenders will be submitted directly to the File Room of Directorate for Public Works not later than 3 pm on August 10th 2007. Tenders shall be in envelopes and duly marked as defined in tender documents. Officer authorized for issuance of certificate on tender submission is Ms. Milica Bakic.
10. Public tender opening is scheduled for August 10th 2007 at 3.30 pm at the premises of Directorate for Public Works at ul. Novaka Miloseva br.18
11. Deadline for decision-making on contract award is 90 days as of the tender opening date.
12. During the validity period of Invitation to Tender any interested tender through its respective authorized representative can receive all the required information related to the tender procedure directly at the premises of Directorate for Public Works every working day from 2pm to 4 pm from contact person Mr. Obrad Mihailovic.
13.Additional Information
Apart from the above-mentioned evidences Tenderer shall furnish Schedule of Works and all other documents as required in Book I and Book II of Tender Documents.
Maximum delivery date for completion of tendered works is nine months as of the date of introduction of the contractor into works.
Enclosed to tender, Tenderer shall submit a Bank Guarantee at the amount of 2 % of the Tender Price as well as Tender Security valid for 90 (ninety) days as of the scheduled tender opening date.
Maximum advance payment is 20% of the offered net value for this public procurement.
Meeting for any additional information is scheduled for July 28th 2007, at 12 o’clock at the premises of Directorate for Public Works, at ul. Novaka Miloseva 18 in Podgorica.
The meeting can be attended by any interested tenderer having purchased tender documents with a respective power of attorney.
