A. Activity Information:

  1. Code Enforcement Program. In order to meet a National Objective and be eligible for Code Enforcement funding:

a)Code Enforcement is eligible only in a primarily residential service area where 51% of the residents are Low/Mod income.

b)Code enforcement is eligible only in a deteriorating or deteriorated area where such enforcement, together with “supportive activities” i.e. public or private improvements, rehabilitation, or services, may be expected to arrest the decline of the area.

c)Code enforcement may only pay for the enforcement of state and/or local codes.

d)Code enforcement cannot pay the costs of correcting code violations.

  1. Relocation Compliance: Although the Uniform Relocation and Real Property Acquisition Policies Act of 1970 (URA) and Section 104(d) of the Housing and Community Act of 1974 (HCDA) are not automatically triggered by code enforcement activities, applicants should be mindful that in some cases the URA and section 104(d) could apply. For example, for purposes of the URA, if the code enforcement action is undertaken to evict persons from a federally-assisted project involving acquisition, rehabilitation or demolition, URA requirements may be triggered. For purposes of section 104(d) of the HCDA, if the code enforcement is being conducted “in connection with” an anticipated development project involving demolition or conversion, the HCDA requirements may apply. See HUD Handbook 1378, Chapters 1-4 J.3 and 7-4 A.3. for guidance on this issue.

  1. Extent of the Solution: Explain how and to what extent the proposed activity will solve the problem:

a)Describe the proposed strategy for using code enforcement together with public or private improvements or services (e.g., a homeowner rehabilitation program) that can be expected to arrest the decline of the service area.

b)Describe the methodology and metrics to be used to assess whether the code enforcement program and other activities will arrest the decline of the service area during the period that CDBG funds are being used to carry out the code enforcement program.

  1. Service Area Low/Mod and Poverty Percentages: Since the applicant pool sets the range for these scores, the Department will determine the percentages and scores. Poverty will always be jurisdiction wide and code enforcement will be determined based on the defined service area.

  1. Activity Implementation Plan: Provide a detailed plan for arresting and eliminating the deterioration within the defined service area. Also, identify resources that are currently available or may become available, in the future, to fund these activities.

E.State Objective Points:

  1. Up to 100 points will be awarded for any activity that demonstrates a jurisdiction has incorporated Disaster Resiliency Long-Term Planning by implementing hazard mitigation and disaster resiliency planning into their general plan, zoning and other planning policies and procedures by the application submittal due date.
  2. Up to 100 points will be awarded for any proposed activity that demonstrates a jurisdiction has implemented Fair Housing outreach planning to promote access to decision-making and program implementation for all segments of the community, including special needs populations, disadvantaged communities, and a variety of socio-economic groups (e.g. households across the income and employment spectrum, ethnically and racially diverse households).
