RECOMMENDATION /
The California Department of Education (CDE) recommends that the State Board of Education (SBE) approve Supplemental Educational Services (SES) Providers from the 2008 Request for Applications (RFA) review process for two years, 2008-2010.
SUMMARY OF PREVIOUS STATE BOARD OF EDUCATION DISCUSSION AND ACTION /In January 2005, the SBE approved new SES regulations along with the revised SES provider application and rubric. At the May, July, and September 2005 meetings, the SBE approved 263 providers for a two-year period (2005-2007). At the May 2006 meeting, the SBE approved 18 providers for a two-year period (2006-2008). In May 2007, the SBE approved 185 providers, and in September 2007 approved 11 additional providers based on approved appeals, for a two-year period. The May 2008 meeting is the third time the SBE will approve SES providers using the annual process.
SUMMARY OF KEY ISSUES /Applications for potential SES Providers were due to the CDE on March 11, 2008. The Title l Policy and Accountability (TIPA) Office reviewed applications at the SES Readers’ Conference March 17-19, 2008.
Title I, Part A, Section 1116(e) of No Child Left Behind (NCLB) requires SES from
SBE-approved providers be offered to parents of low-achieving, low-income students in Program Improvement (PI) schools, Year 2 and beyond. The CDE is responsible for establishing and maintaining a list of SES Providers approved for two years of service, as described in Section 1116(e)(4) of NCLB. The CDE issued a RFA for interested entities.
SES is to be designed specifically to increase the academic achievement of eligible

SUMMARY OF KEY ISSUES (Cont.) /children and includes “tutoring and other academic services” that are:
· chosen by parents
· provided outside the school day
· research-based and demonstrate program effectiveness
The CDE evaluates each application against a rubric based on the SBE-adopted criteria. In order to be approved, applications must adequately address all four elements of the criteria:
· Element I. Program
· Element II. Staff
· Element III. Research-Based and High Quality Program Effectiveness
· Element IV. Evaluation and Monitoring
The process for reviewing the applications is as follows:
· The TIPA Office date-stamped all applications when received and checked applications for completeness.
· The SES Readers’ Conference included specialized training of CDE program consultants selected from across the Department. Two readers reviewed each application by using the rubric based on the SBE-adopted criteria.
· Applications earning discrepant scores or a low rating received a third read.
· The CDE received 118 SES provider applications for the 2008-2010 application period. On April 3, all applicants were notified by e-mail regarding the posting of the list of recommended applications for SBE approval. Appeals by SES providers were submitted in writing by April 10, 2008. The CDE administration has notified each SES provider applicant of the final decision regarding their appeal.
· Application program descriptions have been prepared and compiled for SBE review and approval.
FISCAL ANALYSIS (AS APPROPRIATE) /Federal revenues are apportioned to LEAs to support the use of SES. LEAs must spend an amount equal to a minimum of five percent and a maximum of 15 percent of the Title I, Part A allocation for SES, unless a lesser amount is needed. Title V, Part A Innovative Program funds or other funds may be used to meet this requirement to support SES.
