WEEKLY BULLETIN OF MOTOR CARRIER APPLICATIONS
The applications listed in this publication have been filed with the Commissioner of Transportation during the preceding week.
PASSENGER APPLICATIONS may be disposed of with or without a hearing depending upon the nature and scope of operations involved and the protests received. Attention is directed to the fact that the Commissioner may grant either a certificate or permit in accordance with the facts; irrespective of the type of passenger authority originally requested.
PROPERTY APPLICATIONS will be disposed of without a hearing unless a valid protest is filed. Certificates or permits are not granted to property carriers. All authority forpropertycarriers will read as “property, except household goods, between all points in New YorkState.” There are no property temporary applications.
HOUSEHOLD GOODS APPLICATIONS will be disposed of following a conference unless a valid protest is filed. The Commissioner may grant a probationary certificate based on the applicant’s fitness.
FILING PROTESTS TO APPLICATIONS
All protests must be served on the Commissioner, the applicant and its representative within thirty (30) days of the date of publication herein (except where noted below for temporary passenger applications). All protests must be in writing and set forth the specific nature and grounds of the protests.
PASSENGER APPLICATIONS - Protests to passenger applications, other than applications for charter or special party, will be considered concerning applicant’s fitness to provide service, public convenience and necessity, and/or public interest. Protests to charter or special party applications will be limited to evidence on applicant’s fitness with regard to safety matters only. Protests to temporary applications must be served on the Commissioner, the applicant and its representative within ten (10) days of the date of publication herein.
PROPERTY APPLICATIONS - Protests to applications will be limited to evidence on applicant’s fitness with regard to safety matters only.
HOUSEHOLD GOODS APPLICATIONS - Protests to household goods applications will be limited to evidence on applicant’s fitness only.

Any person interested in a particular application may receive notice of the hearing tobe held thereon by promptly filing a written request therefore with the Commissioner. Each request must specify the particular proceeding in which a hearing notice is desired and the writer’s interest in the proceeding. A general request for notice of hearings cannot be granted.

EMERGENCY TEMPORARY AUTHORITYSection 153 of the Transportation Law requires the Department to collect a $50. fee when accepting an application for temporary authority or emergency temporary authority (ETA). The Department will begin collecting the $50. filing fee for all applications filed on or after July 1, 2011.

EMERGENCY TEMPORARY AUTHORITY
Section 153 of the Transportation Law requires the Department to collect a $50 fee when accepting an application for temporary authority. An application for Emergency Temporary Authority (ETA) is filed pursuant to Section 153(5) and, therefore, the Department will begin collecting the $50 filing fee for all applications filed on or after July 1, 2o11. In light of the fact that an ETA may be needed immediately in some cases, the Department will process the application and issue the ETA pending receipt of the fee within one business day. Failure to pay the fee within one business day will result in the ETA being rescinded and such administrative actions being taken against the applicant as may be available to the Department, including, but not limited to the issuance of a Notice of Violation which can carry a civil penalty of up to $5,000. In addition, the Department may not consider future requests for ETA from any carrier who fails to pay the fee in a timely fashion.
The following regulation (17 NYCRR §502.5) govern the issuance of ETA and should be followed by carriers seeking ETA:
§ 502.5 Applications for emergency authority.
(a) (1) Unless it is demonstrated that, by reason of an unforeseen emergency need, transportation must commence immediately, an application for emergency authority shall be made by letter or telegram, to be received at the office of the department, not later than three working days prior to the date when the transportation is to start.
(2) Where it is demonstrated that because of an unforeseen emergency need the transportation must commence immediately, an application may be made, in person or by telephone, to the office of the chief administrative law judge, during regular office hours. In such event, the chief administrative law judgemay require written confirmation of the telephone request or other oral representation in such manner and within such time limits as he may require.
(b) The written or oral application must show:
(1) that the applicant is ready, willing and able to provide the proposed transportation;
(2) the rate to be applied or the charge to be made;
(3)if the applicant holds no authority from the Commissioner of Transportation, the name of the insurance company carrying applicant's bodily injury and property damage insurance and if applicable, cargo insurance, the amounts of such coverage, the effective date and expiration date of the policy or policies of insurance and the number or numbers of such policies; and
(4)if the applicant intends to carry passengers, evidence that the vehicles to be utilized have been, or prior to the commencement of the transportation involved, will be inspected in accordance with the provisions of the Transportation Law and the rules and regulations of the Commissioner of Transportation promulgated thereunder.
(c) Applications must be accompanied with or followed by letters or telegram by the proposed user or users of the service setting forth:
(1)a description of the transportation involved including the point or points of origin and destination or destinations and date or dates of movement;
(2)facts relied upon to demonstrate that there is an immediate or urgent need for such transportation; and
(3)the period of time during which the service will be required.
